HomeMy WebLinkAboutOrdinance 88- 1266 Landowners to repair sidewalks WHEREAS, Section 7-14-4122 Montana Code Annotated (MCA) authorizes the City Commission to regulate and provide for the construction or repair of sidewalks and foot pavements. NOW, THEREFORE, BE IT ORDAINED by the City Commission of Bozeman, Montana: Section 1 That Section 12.20. be added to the Bozeman Municipal Code as follows: 12.20. Temporary or permanent repair of sidewalk and foot pavements thereof by adjacent or abutting owners; duty to keep in good repair; and, consequences of fai lure to repair. All owners or agents of owners with property abutting upon any street or alley within the corporate limits of the City are required to keep the public sidewalks and foot pavement adjacent to or immediately abutting their property in good order and repair. Each such owner shall be liable to the City for all losses to the City or recoveries from the City for damages to person or property of others caused by his or her fai lure or that of his or her agents to repair and keep in good order and reasonably safe condition all such sidewalks and foot pavements adjacent to or abutting his or her property upon any street or alley within the corporate limits of the City. The City may, at its discretion, through the Director of Public Service, notify such owner that temporary or permanent repairs are necessary to put such sidewalk or foot pavements in good order and such owner shall, within thirty (30) days after such notification, under the supervision of the Director of Public Service, complete such repairs, as specified in such notice. If the person fails to make the required repairs, the City may repair same and the amount so paid shall be a lien upon the lot and may be enforced or the amount recovered against the owner by a suit before any court of competent jurisdiction. PREAMBLE The purpose of this Ordinance is to protect the public by requiring adjacent or abutting landowners to keep public sidewalks and foot pavements in good repair.
