ORDI NANCE NO. 1265
AN ORDINANCE OF THE CITY COMMISSION OF BOZEMAN, MONTANA,
ESTABLISHING AN ANTI-LITTER ASSESSMENT ON UNSECURED OR UNCOVERED
LOADS OF LOOSE MATERIAL BROUGHT TO THE CITY OF BOZEMAN'S LANDFILL
OR OTHER INSTALLATION ESTABLISHED FOR DISPOSING OF SAID LOOSE
MATERIAL.
PREAMBLE
I
The purpose of this Ordinance is to provide for the public health, safety, welfare
and aesthetics by assessing an anti-litter fee for the disposal of loads of
uncovered or uncontained loose material transported to the City of Bozeman's
Landfill or other installation established for disposing of said loose material.
BE IT ORDAI NED by the City Commission of Bozeman, Montana, that Chapter 8.16 of the
Bozeman Municipal Code be amended by adding:
Section
Any person, firm, business, corporation, or agent thereof, transporting a load of loose
material to the City of Bozeman's Landfill or other installation established for disposing of said
loose material which has not been covered or contained in a secured and covered container shall
pay in addition to the established dumping fee, an anti-litter assessment of $5.00 per load.
Section 2
Loose material is defined as including, but not limited to, grass clippings, branches,
leaves, bui Iding debris, garbage, refuse, trash, paper, cardboard, or any other item, article or
material subject to being discharged from a moving vehicle because of movement, vibration, wind
or other physical force.
Section 3
If any prOVISIOn of this ordinance is declared unconstitutional, or the applicability thereof
to any person or circumstances held inval id, the constitutionality of the remainder of the
ordinance and the applicabi lity thereof to other persons and circumstances shall not be affected
thereby.

PROVISIONALLY PASSED AND ADOPTED and approved the City Commission of the City of
Bozeman, Montana, this 8th day of August, 1988.
