ORDINANCE NO. 1263
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, REQUIRING VEHICLES, TRAILERS, OR OTHER FORMS OF
CONVEYANCE TRANSPORTING LOOSE MATERIALS, ON PUBLIC STREETS,
ALLEYS, OR WAYS TO COVER OR OTHERWISE CONTAIN SAID LOOSE MATERIALS
TO PREVENT THE MATERIALS FROM SIFTING, SPILLING, FALLING OUT,
BLOWING OUT OR OTHERWISE LEAVING SAID VEHICLE AND PROVIDING A
PENALTY FOR VIOLATION.
PREAMBLE
I
The purpose of this Ordinance is to provide for the public, health, safety and
welfare through the regulation of the transportation of loose materials on public
streets, alleys and ways and to discourage over-loading of vehicles.
BE IT ORDAI NED by the City Commission of the City of Bozeman, Montana, that Chapter
10.44 of the Bozeman Municipal Code be amended by adding:
Section 1
It shall be unlawful for any person, business, or corporation to transport in any vehicle
or by any other means or manner any loose material likely to sift, fall, spill or be blown about
on any public street, alley or other public way in the city. Each operator of said vehicle shall
cover the contents or shall convey the contents in a secured manner.
Section 2
It shall be unlawful for any person, business or corporation to not immediately gather up
or cause to be gathered up any material which has sifted, fallen, spilled or blown out of his
vehicle.
Section 3
DEFINITION
"Loose material" and "material" includes, but is not limited to, grass clippings, branches,
leaves, bui Iding debris, garbage, trash, paper, cardboard, or any other item, article or material
subject to being discharged from a vehicle in motion, whether because of movement, vibration,
wind or other physical force.

Section 4
Any person, business, or corporation violating this ordinance shall be punished by a fine
not to exceed $500.00.
Section 5
If any provIsIon of this ordinance is declared unconstitutional, or the applicability thereof
to any person or circumstances held invalid, the constitutionality of the remainder of the
ordinance and the applicabi lity thereof to other persons and circumstances shall not be affected
thereby.
PROVISIONALLY PASSED AND ADOPTED and approved the City Commission of the City of
Bozeman, Montana, this 8th day of August, 1988.
