HomeMy WebLinkAboutOrdinance 88- 1257 Adds § 5.56.143; amends §§ 5.56.100 and 5.56.146, gaming licenses ORDI NANCE NO. 1257 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 5.56.100 AND 5.56.146 AND ADDING SECTION 5.56.145 TO THE BOZEMAN MUNICIPAL CODE TO REVISE THE REGULATIONS FOR LICENSES ISSUED FOR CARD TABLES AND ELECTRONIC KENO MACHINES AND THE OVERALL LIMITATION ON GAMING DEVICES PER ESTABLISHMENT. PREAMBLE I The purpose of this ordinance is to change the number of specified gaming devices allowed per establishment to be in compliance with State statute, effective July 1, 1988. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Section 5.56.100 of the Bozeman Municipal Code be, and the same is hereby amended to read as follows: 5.56.100 Issuance under Montana Card Games Act - Payment. Each person obtaining a license for the operation of a card table under the Montana Card Games Act must, in addition, possess a city license for the sale of liquor, beer, or a business license which includes the sale of food, cigarettes or any other consumable products. Each person desiring a license to operate one or more card tables shall pay a per table annual license fee, as set forth in Section 5.06.050. At no time, however, shall any business location be licensed to operate more than a total of ffltll" two card game tables when the prize is money or any item of value. Such license fee shall be due and payable on the thirtieth day of June of each year. Failure to pay the license fee on or before the time stated shall result in the revocation of the license. I Section 2 NEW SECTION That Section 5.56.145 of the Bozeman Municipal Code be, and the same is hereby added to read as follows: 5.56.145 Issuance under Bingo and Raffles Law. Each person seeking to obtain a license for the operation of electronic video keno or bingo machines under the Bingo and Raffles Law must, in addition, possess a city license for the sale of liquor, beer, food, cigarettes, or any other consumable products. Each person desiring a license to operate one or more electronic video keno or bingo machine shall pay a fee as set forth in Section 5.06.044. The annual license fee shall be due and payable on the thirtieth day of June of each year. At no time, however, shall any business location be licensed to operate, in any combination of electronic video keno or bingo machines, more than a total of five (5) machines. Section 3 That Section 5.56.146 of the Bozeman Municipal Code be, and the same is hereby amended to read as follows: 5.56.146 Overall limitation of seV-efl twelve on the number of gambling games, devices and machines authorized by chapter. The maximum aggregate number of gambling games and machines allowed to exist simultaneously in one business location under this chapter is seven twelve. Failure to comply with this section will result in revocation of all licenses issued under this chapter. Section 4 I Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 5 Severabi I ity . If any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
