ORDINANCE NO. 1236
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING SECTIONS 5.06.042 AND 5.06.044 OF THE BOZEMAN
MUNICIPAL CODE REVISING THE FEE STRUCTURE FOR LICENSES ISSUED FOR
VIDEO DRAW POKER AND ELECTRON I C KENO MACHINES TO COMPL Y WITH
STATE LAW.
I PREAMBLE
The purpose of this ordinance is to change the fee schedule for video draw poker
machines and electronic keno machines to comply to State law.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That Section 5.06.042 of the Bozeman Municipal Code be amended to read as follows:
5.06.042 Video Draw Poker Machines.
A. The annual license fee for video draw poker machines under the Video Draw Poker
Machine Control Law of 1985, as amended by House Bill 863 of the 50th Legislature and as
limited in number by Sections 5.56.143 and 5.56.146 of the Bozeman Municipal Code, shall
be ONE HUNDRED DOLLARS ($100.00) per machine.
The annual license fee shall expi re on June 30 of each year and the fee shall be
prorated.
Section 2
That Section 5.06.044 of the Bozeman Municipal Code be amended to read as follows:
5.06.044 Electronic Keno Machines.
The annual license fee for electronic keno machines, as defined by 23-5-602(1) Montana
Code Annotated and, as limited in number by Section 5.56.146, shall be ONE HUNDRED
DOLLARS ($100.00) per -machine.
I The annual license fee shall expi re on June 30 of each year and the fee shall be
prorated.
Section 3
Savings Provision.
This ordinance does not affect rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severabi I ity .
I f any provision of this ordinance is declared unconstitutional, or the appl icabi lity thereof
to any person or circumstances is held invalid, the constitutionality of the remainder of the
ordinance and applicability thereof to other persons and ci rcumstances shall not be affected
thereby.
