ORDI NANCE NO. 1233
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ADDING TO THE CRIMINAL SECTION OF THE BOZEMAN
MUNICIPAL CODE, A SECTION MAKING IT A CRIME FOR ANY PERSON TO
PUBLICLY URINATE OR DEFECATE AND PUNISHMENT FOR VIOLATION
THEREOF.
PREAMBLE
I The purpose of this ordinance is to amend the Bozeman Municipal Code
making it a crime for any person to publicly urinate or defecate without
using a sanitary facility for disposal of human waste and to punish the
violator thereof by fine.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
That Section 9.46.010 of the Bozeman Municipal Code be amended to include the following
provision:
9.46.010 Public Urination and Defecation.
No person within the jurisdictional limits of the City shall publicly defecate or urinate on
streets, sidewalks, alleys, parks, parking lots or other places open to the public including areas
open to the public in buildings unless a sanitary facility capable of and commonly used for
disposal of human urine or excrement is used.
Any person who violates any provision of this chapter shall be guilty of a misdemeanor and
punishable by a fine not to exceed Three Hundred Dollars ($300.00).
