ORDI NANCE NO. 1227
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, VACATING AND ABANDONING A PORTION OF THE ALLEY LOCATED
IN BLOCKS 46 AND 49 OF THE NORTHERN PACIFIC ADDITION TO THE CITY OF
BOZEMAN, MONT ANA.
WHEREAS, the owner of the property abutting the hereinafter described alley in the City
I of Bozeman, Montana, has presented to the City Commission a request for vacation of said alley;
and
WHEREAS, the City Commission of the City of Bozeman, Montana, on the 20th day of October
1986, at its regular meeting, passed and adopted Commission Resolution No. 2639, declaring it
to be the intention of the City Commission of the City of Bozeman to vacate the following alley:
An alley sixteen (16) feet wide between Lots 1 through 11, Block 46, and Lots 28
through 42, Block 49, on the west, and Lot 18, Block 46, and Lots 16 through
27, Block 49, on the east, all in the Northern Pacific Addition to the City of
Bozeman, Montana.
WHEREAS, notice of the adoption of said Resolution was published in the Bozeman Daily
Chronicle at least once, to wit, on the 2nd day of November 1986, as appears from the affidavit
of publication of the publisher of said Bozeman Daily Chronicle, which is on file with the Clerk
of the City Commission of the City of Bozeman; and
WHEREAS, said notice of the adoption of said Resolution has been served in the manner
of the service of summons in civil actions upon all persons whose property abuts upon the
portion of the above-described alley affected by the proposed vacation, which return of service
is on file with the Clerk of the City Commission of the City of Bozeman; and
WHEREAS, said notice, as published and served, designated the 17th day of November
1986 at 7:00 o'clock p.m., at the Commission Room in the City Hall Building, Bozeman, Montana,
as the time and place for hearing objections; and
WH EREAS, no objections to said vacation were presented on the 17th day of November
1986, at the regular meeting of the City Commission, nor were any objections filed in writing
I prior to that meeting.
NOW, THEREFORE, BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
That the following alley within the fOllowing-described tract of land be vacated, provided
that said vacation shall not affect the right of any public utility to continue to maintain its
plant and equipment in said alley, to wit:
An alley sixteen (16) feet wide between Lots 1 through 11, Block 46, and Lots 28
through 42, Block 49, on the west, and Lot 18, Block 46, and Lots 16 through
27, Block 49, on the east, all in the Northern Pacific Addition to the City of
Bozeman, Montana.
PROVISlONALL Y PASSED AND ADOPTED at the regular meeting of the City Commission
of the City of Bozeman held on the 8th day of December 1986.

I, Robin L. Sullivan, Clerk of the Commission of the City of Bozeman, do hereby certify
that the foregoing Ordinance No. 1227 was published by title and number in the Bozeman Daily
Chronicle, a newspaper of general circulation printed and published in said City, in the issue I
dated the 28th day of December 1986, and said proof of such publication is on file in my office.
