HomeMy WebLinkAboutOrdinance 86- 1224 Adds § 18.04.205, 18.04.245 and 18.50.240; amends 8§ 18.10.020, 18.12.020, 18.14.020, 18.20.020, 18.26.020, 18.32.020, 18.46.040, 18.52.140 and 18.62.190, zoning; repeals § 18.04.108 ?1 '~ _ v ORDI NANCE NO. 1224 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING TITLE 18 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR FAMILY CHILD CARE HOMES AND GROUP CHILD CARE HOMES, PROVIDING FOR DEFINITIONS, ZONES IN WHICH THEY ARE PERMITTED AND CONDITIONAL USES, AND PROVIDING FOR OFF-STREET PARKING AND LOADING REQUIREMENTS IN THE CITY OF BOZEMAN, I MONTANA. PREAMBLE The purpose of this ordinance is to provide for child care facilities by eliminating all references to child care homes and provide for family child care homes and group child care homes. The ordinance provides for the new definitions, designates the zoning districts in which the different facilities are permitted and provides for a reduction in the off~street parking and loading requirements. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Chapter 18.04.108 of the Bozeman Municipal Code be and the same is hereby deleted in its entirety. Section 2 That Chapter 18.04.205 of the Bozeman Municipal Code be and the same is hereby amended by adding the following definition: 18.04.205 Family Child Care Home. "Family child care home" means a private dwelling in which supplemental parental care is provided to three to six children including those children under the age of six domiciled on the I same premises. on a regular basis in accordance with applicable state and local regulations. Section 3 That Chapter 18.04.245 of the Bozeman Municipal Code be and the same is hereby amended by adding the following definition: 18.04.245 Group Child Care Home. "Group child care home" means a private dwelling in which supplemental parental care is provided to seven to twelve children, including those children under the age of six domiciled on the same premises, on a regular basis in accordance with applicable state and local regulations. Section 4 That Section 18.10.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.10.020 Permitted Uses. Permitted uses in the A-S District are as follows: 1. Accessory uses and buildings, including single-family or multi-family dwellings to house employees working on the farm or ranch; 2. Agriculture uses; 3. Churches; 4. Conditional uses as provided in Chapter 18.52; 5. Home occupations; I 6. One-fami Iy dwell ings; 7. The sale, on the premises, of products produced thereon; 8. Veterinary clinics; 9. One-family mobile home on permanent foundation which meets all the requirements of Section 18.50.230; 10. Family child care homes in compliance with all requirements of Section 18.50.240; 11. Water pumping stations; 12. Storm water drainage facilities (including collection lines, retention! detention ponds and drainage ways); ORD I NANCE NO. 1224 21L:. 13. Permitted uses in the R-S District are as follows: A. Accessory uses; B. Agriculture uses; C. Barns and animal shelters; D. Churches; E. Conditional uses approved in Chapter 18.52; F. Home occupations; G. Newly constructed one-fami Iy dwell ings; H. Temporary buildings, for and during construction only; I. The keeping of animals and fowl for family food production and the keeping of horses for private use, together with their dependent young, as hereinafter set forth, per two and one-half acres: one horse, or one cow; or two sheep or two goats; or ten rabbits, or thirty-six fowl (chickens, pheasants, pigeons, etc.), or six larger fowl (ducks, geese, turkeys, etc.); J. One-family mobile homes on permanent foundations which meet all requirements of Section 18.50.220; I K. Family child care homes in compliance with all requirements of Section 18.50.240; L. Rooming and boarding houses (maximum of three rooming units plus family quarters) ; H. Temporary buildings for and during construction, only; I. Uses permitted in the R-l and R-2 districts; J. One family mobile homes on permanent foundations which meet all the requirements of Section 18.50.220; K. Family child care homes in compliance with all requirements of Section 18.50.140; L. Professional and business offices; I H. Signs (limited to facade and directional signs which do not flash or reflect light directly onto adjacent properties); I. Temporary buildings for and during construction only; J. Family child care homes in compliance with all requirements of Section 18.50.240; K. Water pumping stations; L. Section 9 I That Section 18.32.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.32.020 Permitted uses. Permitted uses in the B-3 district are: 1. Ambulance service; 2. Apartments; 3. Bakeries; 4. Barber and beauty shops; 5. Butcher shops (retail sales only); 6. Churches; 7. Conditional uses as provided in Chapter 18.52; 8. Dress making; 9. Financial institutions; 10. Fi re stations; 11. Handicraft manufacturing (retail sales only); 12. Health and exercise establishments; 13. Hotels and motels; 14. Laundry, dry cleaning and laundromats; 15. Meeting and lodge halls; 16. Museums, libraries and galleries; I 17. Parking Lots; 18. Photo studios; 19. Printing offices and publishing establishments; 20. Private schools, such as dance, business secretarial and technical, but not private or public pre-school, elementary or secondary schools; 21. Professional and, business offices (for personal services); 22. Public offices; 23. Repair services for clothes, dolls, small appliances, watches, glasses and such other items; 24. Restaurants and cafes; 25. Retail sales, which would include but not be limited to: a. Clothing; b. Food; c. Furniture; d. Hardware; e. Jewelry; f. Novelties; g. Office supplies; h. Pharmaceuticals; but excluding heavy machinery. Please refer to Section 18.04.460 for the definition of retail sales; I 26. Signs; 27. Temporary buildings for and during construction, only; 28. Theaters, except drive-ins; 29. Uses customarily accessory to those listed; 30. Upholstering shops (excludes on-site upholstering services of cars, boats, trucks and other heavy equipment); I 31. Section 10 That Section 18.46.040 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.46.040 Permitted Uses in Mobile Home Districts. In mobile home districts, permitted uses are as follows: A. Accessory buildings and uses customarily incidental thereto. No part of any mobile home park or subdivision shall be used for nonresidential purposes, except such uses that are required for direct servicing and the well-being of park residents and for management and maintenance of the park or subdivision. Nothing in this section shall be deemed as prohibiting the sale of a mobile home located on a mobile home stand and connected to the pertinent utilities; B. Mobile home parks on sites of not less than ten acres in area, with a minimum of twenty-five lots; c. Mobile home subdivisions on sites of not less than ten acres in area; I D. Family child care homes in compliance with all requirements of Section 18.50.240; E. Water pumping stations; F. Storm water drainage facilities (including collection lines, retention/detention ponds and drainage ways); G. Sanitary sewer and storm sewer lift stations; H. Local service telephone lines and cables; I . Local service electrical distribution lines and cables; J. Local service cable television lines; K. Local service electronic data transmission lines and cables; L. Water and sanitary sewer distribution and collection lines; M. Public and amateur radio antennae and towers. Section 11 That Section 18.50 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.50.240 Review of Family Child Care Homes. Family child care homes as defined in Section 18.04.205 are permitted uses in all zoning districts in which residential uses are permitted pursuant to compliance with the requirements of this section. A. Prior to issuance of an occupancy permit, an applicant requesting to locate a family child care home in a residential dwelling unit shall submit the following information to the I Planning Director for review and approval. 1. Written approval from the Fire Marshall indicating that he has inspected the premises and found it in general compliance with all appropriate fire-safety codes; 2. Written approval from the Building Official indicating that an inspection of the premises has been made and was found in general compliance with the building, electrical, plumbing and mechanical codes as well as any other applicable codes and standards; ORDINANCE NO. 1224 218 3. Documentation of registration with the Montana Department of Social and Rehabilitation Services; 4. A site plan designating a safe and convenient off-street area for the loading and unloading of children; 5. In addition to the above no signs associated with the family child care home shall be allowed. B. When the above criteria has been satisfied the Planning Director shall forward written I approval to the Building Official for issuance of an occupancy permit. Section 12 That Section 18.52.140 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.52.140 Conditional uses designated for individual zoning districts. The following uses may be permitted as conditional uses in the districts as specified: A. AS Agricultural Suburban District. Community residential facilities; public and private parks and playgrounds; golf courses and country clubs; hunting and fishing clubs; schools and travel trailer parks; television and radio broadcasting studios and transmitters; ambulance service; group child care homes; personal use air fields; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; solid waste landfill, and police and fire stations. B. R-S Residential Suburban District. Community residential facilities; schools (nonboard, nursery, elementary, junior and senior high); public and private parks and playgrounds; golf courses and country clubs; other recreational uses; FCC earth stations; PUD's as provided in Chapter 18.54 of this title; ambulance service; group child care homes; I transport gas. oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and police and fire stations. C. R-l Single-family Residential - Low-density District. Community residential facilities; schools; libraries; public and private parks and playgrounds; golf courses and country clubs; PUD's as provided in Chapter 18.54 of this title; ambulance service; group child care homes; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and police and fire stations. D. R-2 Single-family Residential-Medium Density District. Same as R-1 district. E. R-2-A Single-family Residential-Medium Density District. Same as R-2 district. F. R-3 Residential-Medium Density District. Conditional uses provided in the R-l and R-2 districts that are not permitted uses in the R-3 district, as provided in Chapter 18.58 of this title; PUD's as provided in Chapter 18.54 of this title; fraternity and sorority houses; medical offices; group child care homes; transport gas, oil and coal pipelines (interstate and I intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and pol ice and fi re stations. J. R-O Residential-Office District. All other ordinances and parts of ordinances in conflict with the provisions are hereby repealed. Section 15 Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 16 Severability. If any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
