It)9 ORDI NANCE NO. 1221 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING NUMEROUS SECTIONS OF CHAPTER 18 OF THE BOZEMAN MUNICIPAL CODE TO ALLOW SPECIFIC TYPES OF PUBLIC UTILITY FACILITIES AS PERMITTED USES AND/OR CONDITIONAL USES IN THE VARIOUS ZONING DISTRICTS, TO DELETE THE DEFINITION OF PUBLIC UTILITY FACILITY AND SUPPLEMENTARY SCREENING REQUIREMENTS FOR A PUBLIC UTILITY FACILITY I AND TO DELETE PUBLIC UTILITY FACILITY AS A PERMITTED USE IN THE "M-1" AND "TR" DISTRICTS AND AS A CONDITIONAL USE IN THE "AS," "R-S," "R-l," "R-MH," "R-O," "B-2" AND "PLI" DISTRICTS IN THE CITY OF BOZEMAN, MONT ANA. PREAMBLE The purpose of this ordinance is to provide for specific types of public utility facilities as permitted uses and/or conditional uses in the various zoning districts, to delete the definition of public utility facility and supplementary screening requirements for a public utility facility and to delete public utility facility as a permitted use in the "M-l" and "TR" districts and as a conditional use in the "AS," "R-S," "R-1," "R-MH," "R-O," "B-2," and "PLI" districts. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Section 18.10.020 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.10.020 Permitted uses. Permitted uses in the A-S district are as follows: 1. Accessory uses and buildings, including single-family or multi-family dwellings to house employees working on the farm or ranch; 2. Agriculture uses; 3. Churches; I 4. Conditional uses as provided in Chapter 18.52; 5. Home occupations; 6. One-fami Iy dwell ings; 7. The sa Ie, on the premises, of products produced thereon; 8. Veterinary clinics; 9. One-family mobile home on permanent foundation which meets all the requirements of Section 18.50.230; 10. Water pumpi ng stations; 11. Public and amateur radio antennae and towers; Section 2 That Section 18.12.020 of the Bozeman Municipal Code be and the same is hereby amended as fol lows: 18.12.020 Permitted uses. I Permitted uses in the R-S district are as follows: A. Accessory uses; B. Agriculture uses; C. Barns and animal shelters; D. Churches; E. Conditional uses approved in Chapter 18.52; F. Home occupations; G. Newly constructed one-family dwellings; H. Temporary buildings, for and during construction only; ORDINANCE NO. 1221 --.--...- l~CJ I. The keeping of animals and fowl for family food production and the keeping of horses for private use, together with their dependent young, as hereinafter set forth, per two and one-hal f acres: one horse, or one cow; or two sheep or two goats; or ten rabbits, or thirty-six fowl (chickens, pheasants, pigeons, etc.), or six larger fowl (ducks, geese, turkeys, etc.); J. Rooming and boarding houses (maximum of three rooming units plus family quarters) ; H. Temporary buildings for and during construction, only; I. Uses permitted in the R-l and R-2 districts; J. Professional and business offices; H. Signs (limited to facade and directional signs which do not flash or reflect light directly onto adjacent properties); I. Temporary buildings for and during construction only. J. Water pumping stations; K. Storm water drainage facilities (including collection lines, retention/detention ponds and drainage ways); I L. Sanitary sewer and storm sewer lift stations; M. Local service telephone lines and cables; N. Local service electrical distribution lines and cables; O. Local service cable television lines; P. Signs (only one facade sign per business, plus one directory sign per I district) ; I. Temporary buildings for and during construction, only; J. Variety stores. K. Water pumping stations; L. Equipment sales and service; 10. Financial institutions; 11. Fi re stations; 12. Food and drug stores; 13. Frozen food storage and locker rentals; 14. Furniture stores; 15. Hotels and motels; 16. Gasoline service stations; 17. Laundries and dry cleaning establishments; 18. Liquor stores; I 19. Mortuaries; 20. Post offices; 21. Professional and business offices; 22. Permitted uses in the B-3 district are: 1. Ambulance service; 2. Apartments; 3. Bakeries; I 4. Barber and beauty shops; 5. Butcher shops (retail sales only); 6. Churches; 7. Conditional uses as provided in Chapter 18.52; 8. Dress making; 9. Financial institutions; 10. Fi re stations; 11. Handicraft manufacturing (retail sales only); 12. Health and exercise establishments; 13. Hotels and motels; 14. Laundry, dry cleaning and laundromats; 15. Meeting and lodge halls; 16. Museums, libraries and galleries; 17. Parking Lots; 18. Photo studios; 19. Printing offices and publishing establishments; 20. Private schools, such as dance, business secretarial and technical, but not private or public pre-school, elementary or secondary schools; 21. Professional and business offices (for personal services); 22. Publ ic offices; 23. Repair services for clothes, dolls, small appliances, watches, glasses and such I other items; 24. Section 9 That Section 18.34.020 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.34.020 Permitted uses. Permitted uses in the M-l district are as follows: I 1. Accessory uses; 2. Ambulance service; 3. Building contractors' establishments; 4. Building sales; 5. Cabinet shops; 6. Churches; 7. Conditional uses as provided in Chapter 18.52; 8. Enclosed warehousing; 9. Fi re stations; 10. Flour and feed mills; 11. Food processing plants; 12. Gasoline service stations; 13. Grain elevators; 14. Greenhouses; 15. Machine shops; 16. Manufacturing of light consumer goods, i.e., electronic equipment, appliances, furniture, beverages; 17. Outside storage if accessory to permitted use and if screened from the street and surrounding properties by solid fence or dense plantings at least six feet high; I 18. Paint shops; 19. Repair and service establishments for light consumer goods, i.e., automobiles, appliances, furniture; 20. Signs; 21. Sign shops; 22. Temporary buildings, for and during construction only; 23. Truck and rail terminal facilities; 24. Vehicle and boat sales. 25. Water pumping stations; 26. Conditional uses as provided in Chapter 18.52; ORDINANCE NO. 1221 185 D. Laboratories; E. Light manufacturing and assembly compatible with intent of district; F. Pilot plants; G. Prototype development; H. Signs (one identification sign per establishment); I. Technology research establishments; I J. Temporary buildings, for and during construction only. K. Water pumping stations; L. Storm water drainage facilities (including collection lines, retention/ detention ponds and drainage ways); M. Sanitary sewer and storm sewer lift stations; N. Accessory buildings; B. Ambulance service; C. Cemeteries; D. Museums, zoos, historic and culture exhibits; E. Other public buildings, i.e., fire and police stations and municipal buildings; I F. Public and nonprofit, quasi-public institutions, i.e., universities, elementary, junior and senior high schools and hospitals; G. Publicly owned land used for parks, playgrounds and open space; H. Temporary buildings for and during construction only; I . Water pumping stations; J. Storm water drainage facilities (including collection lines, retention/detention ponds and drainage ways); K. Sanitary sewer and storm sewer lift stations; L. Local service telephone lines and cables; M. Local service electrical distribution lines and cables; N. Local service cable television lines; O. Fire stations. Section 12 That Section 18.46.040 of the Bozeman Municipal Code be and the same is hereby amended as fol lows: 18.46.040 Permitted uses in mobile home districts. In mobi Ie home districts. permi tted uses a re as follows: I A. Accessory buildings and uses customarily incidental thereto. No part of any mobi Ie home park or subdivision shall be used for nonresidential purposes, except such uses that are required for direct servicing and the well-being of park residents and for management and maintenance of the park or subdivision. Nothing in this section shall be deemed as prohibiting the sale of a mobile home located on a mobile home stand and connected to the pertinent utilities; B. Mobile home parks on sites of not less than ten acres in area, with a minimum of twenty-five lots; ORDINANCE NO. 1221 195 . C. Mobile home subdivisions on sites of not less than ten acres in area; D. Section 13 That Section 18.52.140 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.52.140 Conditional uses designated for individual zoning districts. The following uses may be permitted as conditional uses in the districts as specified: A. AS Agricultural Suburban District. Community residential facilities; public and private parks and playgrounds; golf courses and country clubs; hunting and fishing clubs; schools and travel trailer parks; television and radio broadcasting studios and transmitters; ambulance service; child care homes; personal use air fields; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); publ ic treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; solid waste landfill, and police and fire stations. B. R-S Residential Suburban District. D. R-2 Single-family Residential-Medium Density District. Same as R-1 district; E. R-2-A Single-family Residential-Medium Density District. Same as R-2 district; F. R-3 Residential-Medium Density District. Conditional uses provided in the R-l and R-2 districts that are not permitted uses in the R-3 district, as provided in Chapter 18.58 of I this title; PUD's as provided in Chapter 18.54 of this title; fraternity and sorority houses; medical offices; child care homes; child care centers; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and ORDINANCE NO. 1221 181 structures; and police and fire stations. G. R-4 Residential-Medium Density Apartment District. Same as R-3 district; H. R-5 Residential-High Density District. Same as R-4 district. J. R-MH Residential-Mobile Home. Child care homes; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, I sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and pof-rceand fire stations. J. R-O Residential-Office District. Community residential facilities; nursing homes and hospitals; churches; public and private parks and playgrounds; other types of medical facilities or personal services not listed as a permitted use; PUD's as provided in Chapter 18.54 of this title; ambulance service; child care homes; child care centers; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and police and fire stations. K. B-1 Neighborhood Business District. Retail uses in addition to those permitted uses listed, but limited to those serving the customer directly; gasoline service stations; professional and business office uses; child care centers; restaurants serving alcoholic beverages as an accessory use; transport gas, oil and coal pipelines (interstate and intrastate); electric sub- stations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio I antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; other accessory facilities, equipment and structures; and police and fire stations. L. B-2 Community Highway Business District. Retail uses in addition to those permitted uses listed; bars, taverns and cocktail lounges; wholesale distributors with on-premises retail outlets, provided warehousing is limited to commodities which are sold on the premises; amusement and recreational activities; shopping centers; travel trailer p2rks as provided in Chapter 18.60 of this title; residence for owner or caretaker; PUD's as provided in Chapter 18.54 of this title; television and radio broadcasting studios; child care centers; restaurants serving alcoholic beverages as an accessory use; tire sales and installation (including front end and wheel alignment and installation of shock absorbers); transport gas, oi I and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial offices; telephone exchanges and repeater stations; and other accessory facilities, equipment and structures. M. B-3 Central Business District. Amusement and recreation activities; auction rooms; bars, taverns and cocktail lounges; transportation and utility stations; drive-in banks and cleaners; radio and TV broadcasting and transmitting studios; civic centers; service stations and auto service centers; car washes (hand operated); auto upholstery shops; auto body shops; I muffler sales and service shops; sign paint shops (not neon sign fabrication); planned unit developments as provided in Chapter 18.54; child care homes; child care centers; restaurants serving alcoholic beverages as an accessory use; transport gas, oil and coal pipelines (interstate and intrastate); electric substations; electrical transmission lines (interstate and intrastate); public supply facilities (electric and gas); public treatment facilities (water, sanitary sewer and storm sewer); public domestic water storage facilities; water fill stations for fire fighting equipment; commercial radio antennae and towers; telephone satellite community dial ORDINANCE NO. 1221 198 offices; telephone exchanges and repeater stations; and other accessory facilities, equipment and structures. That Sections 18.04.450 and 18.50.120 of the Bozeman Municipal Code be and the same are hereby deleted in their entirety. ORDINANCE NO. 1221 1~9 Section 15 Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Sect ion 16 Severability.
