ORDI NANCE NO. 1219
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING CHAPTERS 18.04 AND 18.52.140(A) OF THE BOZEMAN
MUNICIPAL CODE, TO ALLOW PERSONAL USE AIR FIELDS AS A CONDITIONAL
USE IN THE "A-S" (AGRICUL TURAL SUBURBAN) DISTRICT AND TO PROVIDE
FOR THE DEFINITION OF PERSONAL USE AIR FIELD IN THE CITY OF
BOZEMAN, MONT ANA.
PREAMBLE I
The purpose of this ordinance is to provide for personal use air fields as a
conditional use in the "A-S" (Agricultural Suburban) District and to provide for
the definition of personal use air field.
BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That Chapter 18.04 of the Bozeman Municipal Code be and the same is hereby amended
by adding the following definition:
18.04.027 Air Field, Personal Use.
"Personal use air field" means any unsurfaced earth or turn area or facility of land
which is privately owned and operated, and is designed, used or intended to be used by
private single engine, fixed-wing aircraft, not exceeding 200 horsepower, for landing and
taking off of aircraft, including not more than one support building for covered storage and
small quantities of supplies. A personal use air field as used in this section means an airstrip
restricted, except for aircraft emergencies, to use by the owner which is not directed towards
business or commercial functions. Flights to and from shall be limited to daylight VFR
conditions and shall conform with FAR, Part 91-79.
Section 2 I
That Section 18.52. 140( A) of the Bozeman Municipal Code be and the same is hereby
amended as fol lows:
18.52.140(A) Conditional Uses Designated.
for Individual Zoning
A. AS Agriculture Suburban District. Community residential facilities; public and
private parks and playgrounds; golf courses and country clubs; hunting and fishing clubs;
schools and travel trailer parks; television and radio broadcasting studios and transmitters;
ambulance service, child care homes; public utility facilities; and personal use air fields
Section 3
Savings Provision.
This ordinance does not affect rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severability.
If any provision of this ordinance is declared unconstitutional, or the applicability
thereof to any person or circumstances is held invalid, the constitutionality of the remainder of
the ordinance and applicability thereof to other persons and circumstances shall not be affected
thereby.
