ORDINANCE NO. 1216
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, VACATING AND ABANDONING A PORTION OF THE ALLEY LOCATED
IN BLOCK C OF TRACY'S SECOND ADDITION TO THE CITY OF BOZEMAN,
MONT ANA.
I WHEREAS, the owners of most of the properties abutting the hereinafter described alley
in the City of Bozeman, Montana, have presented to the City Commission a request for vacation
of said alley; and
WHEREAS, the City Commission of the City of Bozeman, Montana, on the 16th day of June
1986, at its regular meeting, passed and adopted Commission Resolution No. 2610, declaring it
to be the intention of the City Commission of the City of Bozeman to vacate the following alley:
An alley twenty (20) feet wide between Lots 1 through 3 inclusive on the south
and Lots 18 through 20 inclusive on the north in Block C of Tracy's Second
Addition to the City of Bozeman, Montana.
WHEREAS, notice of the adoption of said Resolution was published in the Bozeman Dai Iy
Chronicle at least once, to wit, on the 22nd day of June 1986, as appears from the affidavit of
publication of the publisher of said Bozeman Dai Iy Chronicle, which is on file with the Clerk of
the City Commission of the City of Bozeman; and
WHEREAS, said notice of the adoption of said Resolution has been served in the manner
of the service of summons in civil actions upon all persons whose property abuts upon the
portion of the above-described alley affected by the proposed vacation, which return of service
is on file with the Clerk of the City Commission of the City of Bozeman; and
WHEREAS, said notice, as published and served, designated the 7th day of July 1986 at
7:00 o'clock p.m., at the Commission Room in the City Hall Building, Bozeman, Montana, as the
time and place for hearing objections; and
WHEREAS, no objections to said vacation were presented on the 7th day of July 1986, at
I the regular meeting of the City Commission, nor were any objections filed in writing prior to
that meeting.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
That the following alley within the following-described tract of land be vacated, provided
that said vacation shall not affect the right of any public utility to continue to maintain its
plant and equipment in said alley, to wit:
An alley twenty (20) feet wide between Lots 1 through 3 inclusive on the south
and Lots 18 through 20 inclusive on the north in Block C of Tracy's Second
Addition to the City of Bozeman, Montana.
PROVISIONALL Y PASSED AND ADOPTED at the regular meeting of the City Commission
of the City of Bozeman held on the 2nd day of September 1986.
