ORDINANCE NO. 1207
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING SECTIONS 5.06.042 AND 5.06.044 OF THE BOZEMAN
MUNICIPAL CODE REVISING THE FEE STRUCTURE FOR LICENSES ISSUED FOR
VIDEO DRAW POKER AND ELECTRONIC KENO MACHINES.
PREAMBLE
I The purpose of this ordinance is to change the fee schedule for video draw poker
machines and electronic keno machines.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That Section 5.06.042 of the Bozeman Municipal Code be amended to read as follows:
5.06.042 Video Draw Poker Machines.
A. The annual license fee for video draw poker machines under the Video Draw
Poker Machine Control Law of 1985, as I imited in number by Sections 5.56. 143
and 5.56.146, shall be as follows per business location:
1. First poker machine $ 500 per machine location
2. Second or subsequent
poker machine $1,000 per machine location
B. The annual license fee shall be prorated on a monthly basis for the applicants who apply
after July 31 and who were not licensed during the license year immediately preceding.
Section 2
That Section 5.06.044 of the Bozeman Municipal Code be amended to read as follows:
I 5.06.044 Electronic Keno Machines.
The annual license fee for electronic keno machines under the Bingo and Raffles Law, as
limited in number by Section 5.56.146, shall be as follows per business location:
A. First keno machine $ 500 per machine location
B. Second or subsequent
keno machine $1,000 per machine location
Section 3
Savings Provision.
This ordinance does not affect rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severability.
If any provision of this ordinance is declared unconstitutional, or the applicability
thereof to any person or circumstances is held invalid, the constitutionality of the remainder of
the ordinance and applicability thereof to other persons and circumstances shall not be affected
thereby.
