HomeMy WebLinkAboutOrdinance 86- 1204 Repeals and replaces Ch. 15.12, Mechanical Code 12Lt ORDINANCE NO. 1204 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 15.12 OF THE BOZEMAN MUNICIPAL CODE REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, IN- STALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OR USE OF HEATING, VENTILATING, COOLING, RE- FRIGERATION SYSTEMS, INCINERATORS AND OTHER MISCELLANEOUS HEAT-PRODUCING APPLIANCES; AND REPEALING ORDINANCE NUMBERS 1041 I and 1120. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS: Section 1 That Chapter 15. 12 of the Bozeman Municipa I Code be and the same is hereby amended to read as follows: 15.12.010 Document Adopted by Reference--Copies on File. A certain document, three copies of which are on file in the office of the Building Official of the City of Bozeman, being marked and designated as the "Uniform Mechanical Code, II 1985 Edition, published by the I nternational Conference of Building Officials, be and the same is hereby adopted as the Mechanical Code of the City of Bozeman for regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance of heating, ventilation, cooling, refrigeration systems, incinerators, and other miscellaneous heat-producing appliances in the City of Bozeman; providing for issuance of permits and collec- tion of fees therefore; providing penalties for violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of such "Uniform Mechanical Code," 1985 Edition, published by the International Conference of Building Officials, on file in the office of the Building Official, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance; save and except such portions thereof as have been deleted, I modified, or amended as hereinafter set forth. 15.12.020 Mechanical Permit Fees The fee schedule at Table No. 3-A of the Uniform Mechanical Code is hereby amended to read as follows: Table No. 3-A--Mechanical Permit Fees Cost of Mechanical System Mechanical Permit Fee o - $1,000 $20 $1,001 - $10,000 $20 for the first $1,000 plus $5 for each additional $1,000 or fraction thereof, to and including $10,000 $10,001 - $50,000 $65 for first $10,000 plus $4 for each additional $1,000 or fraction thereof, to and including $50,000 $50,001 $225 for first $50,000 plus $2 for each additional $1,000 or fraction thereof to and including $100,000 $100,000 $325 for first $100,000 plus I $0.50 for each additional $1,000 or fraction thereof, to and including $1,000,000 $1,000,000 $775 for first $1,000,000 plus $0.25 for each additional $1,000 or fraction thereof ORDINANCE NO. 1204 12S Note: The mechanical cost shall be the cost to the owner of all labor charges and all mechanical materials and equipment installed as part of the mechanical system. The cost of the plumbing system, which is covered by the Uniform Plumbing Code, is not to be included. Section 2 Ordinances Repealed. I All other ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. These are: Ordinance No. 1041, entitled AN ORDI NANCE OF THE CITY OF BOZEMAN, MONT ANA, ENACTING SECTION 14.20 OF THE BOZEMAN MUNICIPAL CODE, REGULATING AND CON- TROLLING THE DESIGN, CONSTRUCTION, INSTALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING, REFRIGERATI'ON SYSTEMS, INCINERATORS, AND OTHER MISCELLANEOUS HEAT PRODUCING APPLIANCES IN THE CITY OF BOZEMAN, MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; PROVI DI NG PENAL TIES FOR THE VIOLATION THEREOF; REPEALING ORDINANCE NO. 982 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH, passed on November 21,1979, currently codified as Section 15.12.010, Bozeman Municipal Code. Ordinance No. 1120, entitled AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTION 15.12.010 OF THE BOZEMAN MUNICIPAL CODE, REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, INSTALLATION, QUALITY OF MATERIALS, LOCATION, OPERATION AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING, REFRIGERATION SYSTEMS, INCINERATORS, AND OTHER MISCELLANEOUS HEAT PRODUCING APPLIANCES IN THE CITY OF BOZEMAN, MONTANA, PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE, IN THE CITY OF BOZEMAN, MONTANA, passed on February 7,1983, currently codified as Sections 15.12.010 and 15.12.020, Bozeman Municipal Code. I Section 3 Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 4 Severability If any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
