HomeMy WebLinkAboutOrdinance 86- 1203 Repeals and replaces Ch. 15.16, plumbing code 121 ORDINANCE NO. 1203 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 15.16 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY BY REGULATING THE ERECTION, INSTALLATION, ALTERATION, ADDITION, REPAIR, RELOCATION, REPLACEMENT, MAINTENANCE OR USE OF ANY PLUMBING SYSTEM IN THE CITY OF BOZEMAN, AND REPEALING ORDINANCE I NUMBERS 1042 AND 1121. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS: Section 1 That Chapter 15.16 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 15.16.010 Document Adopted by Reference--Copies on File. A certain document, three copies of which are on file in the office of the Building Official of the City of Bozeman, being marked and designated as the II Uniform Plumbing Code, II 1985 Edition, as published by the I nternational Association of Plumbing and Mechanical Officials, be and the same is hereby adopted as the Plumbing Code of the City of Bozeman for the regulation of plumbing and drainage systems in the City of Bozeman; providing for penalties for violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of the "Uniform Plumbing Code, II 1985 Edition, as published by the International Association of Plumbing and Mechanical Officials on file in the office of the Building Official, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance; save and except such portions thereof as have been deleted, modified, or amended as hereinafter set forth. I Section 2 15.16.020 Additions. The following paragraphs shall be added to the Uniform Plumbing Code. Add Section 20.15 to PART l--Administration of the Uniform Plumbing Code, as follows: 20.15 BONDS: Every Master Plumber doing plumbing work in the City of Bozeman shall file with the City, a bond in the sum of $5,000 conditioned that he will in good faith perform all things required of him by the laws of the City of Bozeman. Said bond shall be filed in the office of the Building Official for approval. Add Section 20.16 to PART I--Administration of the Uniform Plumbing Code as follows: 20.16 CONNECTIONS TO SEWER AND WATER MAINS: The City of Bozeman shall make all service connections (doing all necessary work and furnishing necessary materials) from the sewer and water mains to the property line; charges for such work shall be paid by the property owner or his agent and accompany the appl ication for service connections. Water services, from property line to and including the water meter, shall be installed by the City Water Department upon proper application by the owner or I his agent and receipt of a deposit based upon the estimated cost; provided, that any excess over the actual costs shall be refunded to the applicant upon completion of the work. Should the actual cost be more than the estimated deposit the owner or his agent shall pay the additional fee. Section 3 15.16.030 Schedule of Fees Amended--Plumbing Permit Fees. The schedule of fees in the Uniform Plumbing Code is hereby amended to read as follows: ORDINANCE NO. 1203 122 Plumbing Permit Fees Fee For issuing each permit $20.00 For each plumbing fixture, or set of fixtures on one trap including water, drainage, piping and back- flow protection thereof $ 4.00 I For each building sewer and each trailer park sewer $10.00 For each water heater and vent $ 4.00 For each gas piping system: . Qne to four outlets $ 6.00 Five or more, per outlet $ 1. 50 For installation, alteration or repair of water piping and/or water treatment equipment $ 4.00 Building storm drains and/or rain water leaders per each $ 4.00 For repair or alteration of drainage or vent piping $ 4.00 For each lawn sprinkler system and/or fire protection system, including backflow devices $ 6.00 For each mobile home inspection including gas lines, venting and appliances, including issuance of permit $22.50 Section 4 I Ordinances Repealed. All other ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. These are: Ordinance No. 1042, entitled AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTION 16.04 OF THE BOZEMAN CODE, PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REQUIRING A PERMIT AND INSPECTION FOR THE INSTALLATION OR ALTERATION OF PLUMBING AND DRAINAGE SYSTEMS; DEFINING CERTAIN TERMS; ESTABLISHING MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING AND DRAINAGE SYSTEMS AND THE INSPECTION THEREOF; PROVIDING PENAL TIES FOR ITS VIOLATION AND REPLEAING ORDINANCE NO. 983 AND ALL OTHER ORDINANCES OR PARTS THEREOF OF THE CITY OF BOZEMAN IN CONFLICT HEREWITH, passed on November 21, 1979, currently codified as Sections 15. 16.010, 15. 16.020 and 15.16.030, Bozeman Municipal Code. Ordinance No. 1121, entitled AN ORDI NANCE OF THE CITY OF BOZEMAN, MONT ANA, AMENDING CHAPTER 15.16 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REQUIRING A PERMIT AND INSPECTION FOR THE INSTALLATION OR ALTERATION OF PLUMBING AND DRAINAGE SYSTEMS; DELETING THE FEE SCHEDULE IN SECTION 20.7, PART I AND REPLACING WITH A NEW FEE SCHEDULE IN THE CITY OF BOZEMAN, MONTANA, passed on February 7,1983, currently codified as Sections 15.16.010 and 15.16.030, Bozeman MunicipaJ Code. I Section 5 Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. ORDINANCE NO. 1203 123 Section 6 Severability I f any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
