ORDINANCE NO. 1202
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING CHAPTER 15.04 OF THE BOZEMAN MUNICIPAL CODE
PROVIDING FOR THE REGULATION, ERECTION, CONSTRUCTION, EN-
LARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION,
CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND
MAINTENANCE OF ALL BUILDINGS AND STRUCTURES IN THE CITY OF
I BOZEMAN, MONTANA; AND REPEALING ORDINANCE NUMBERS 1043 and 1119.
BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That Chapter 15.04 of the Bozeman Municipal Code be and the same is hereby amended
to read as follows:
5.04.010 Document Adopted by Reference.
A certain document, three copies of which are on file in the office of the Building
Official of the City of Bozeman, Montana, being marked and designated as the "Uniform Building
Code" (including all appendixes), 1985 Edition, and the "Uniform Building Code Standards, II
1985 Edition, published by the I nternational Conference of Building Officials, be and the same
is hereby adopted as the Building Code of the City of Bozeman for regulating the erection,
construction, enlargement, alteration, repair, moving, removal, demol ition, conversion,
occupancy, equipment, use, height, area and maintenance of all buildings and structures in the
City of Bozeman, Montana; providing for the issuance of permits and collection of fees
therefore; providing penalties for violation of such code; and each and all of the regulations,
provisions, penalties, conditions and terms of the aforesaid "Uniform Building Code" and
"Uniform Building Code Standards," 1985 Editions, are hereby referred to, adopted and made a
part hereof as if fully set out in this chapter; save and except such portions thereof as have
been deleted, modified, or amended as hereinafter set forth.
I 15.04.020 Table No. 3-A Amended--Building Permit Fees.
Table 3-A of the Uniform Building Code, 1985 Edition, is amended as follows: for
purposes of establishing the permit fee and the plan review fee as required in Section 304,
Table 3-A as found in the II Uniform Bui Iding Code," 1982 Edition, is hereby substituted for
Table 3-A in the "Uniform Building Code," 1985 Edition.
15.04.030 Section 402 Amended--Definitions.
Section 402 of the "Uniform Building Code, II 1985 Edition, is amended as follows:
Alley is any public space or thoroughfare less than twenty (20) feet but not less than
ten (10) feet in width which has been dedicated or deeded to the public for the public use.
Apartment house is any building, or portion thereof, which contains five (5) or more
dwelling units, and for purposes of this code, includes residential condominiums.
Section 2
All other ordinances and parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed. These are:
Ordinance No. 1043, entitled AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA,
AMENDING CHAPTER 14.08 OF THE BOZEMAN MUNICIPAL CODE AND REGULATING THE
ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL,
DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND
I MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF BOZEMAN,
MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES
THEREFORE; PROVIDING PENAL TIES FOR THE VIOLATION THEREOF; REPEALING ORDINANCE
NO. 978 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT THEREWITH, passed November 28, 1979, currently codified as
Section 15.04.020, Bozeman Municipal Code.

REGULATION, ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING,
REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND
MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF BOZEMAN,
MONTANA, passed February 7, 1983, currently codified as Section 15.04.010, Bozeman Municipal
Code.
Section 3 I
Savings Provision.
This ordinance does not affect rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severability
If any provision of this ordinance is declared unconstitutional, or the applicability
thereof to any person or circumstances is held invalid, the constitutionality of the remainder of
the ordinance and applicability thereof to other persons and circumstances shall not be affected
thereby.
PROVISIONALLY PASSED, ADOPTED AND APPROVED by the City Commission of the City
of Bozeman, Montana, this 21st day of April 1986.
