HomeMy WebLinkAboutOrdinance 86- 1199 Adds 8 18.04.275; amends §§ 18.38.030, 18.38.040, 18.38.040, 18.38.060 and 18.62.190, zoning 1 U~) ORDINANCE NO. 1199 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 18.04 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR THE DEFINITION OF IMPERVIOUS SURFACES; AMENDING SECTIONS 18.38.030 THROUGH 18.38.060, PROVIDING FOR LOT AREA AND WIDTH, LOT COVERAGE, YARD SPACES AND BUILDING HEIGHT IN THE TR-TECHNOLOGY RESEARCH DISTRICT; AND AMENDING TABLE A OF SECTION I 18.62.190 PROVIDING FOR OFF-STREET PARKING AND LOADING REQUIRE- 'MENTS IN THE TECHNOLOGY RESEARCH DISTRICT IN THE CITY OF BOZEMAN, MONTANA. PREAMBLE The purpose of this ordinance is to provide for specific development guidelines such as lot area and width, lot coverage, yard spaces, building height and off-street parking and loading requirements in the TR- Technology Research District. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Chapter 18.04 of the Bozeman Municipal Code be and the same is hereby amended by adding the following definition: 18.04.275 Impervious Surfaces. Impervious surfaces are all principal and accessory buildings, roads, sidewalks, patios, parking areas, areas paved in concrete or asphalt and surfaces which reduce or prevent absorp- tion of stormwater. Section 2 That Section 18.38.030 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.38.030 Lot Area and Width. Lot area for the TR District shall not be less than one acre and no lot width shall be I less than one hundred fifty feet. Section 3 That Section 18.38.040 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.38.040 Lot Coverage. Not more than sixty percent of the total lot area shall be occupied by impervious sur- faces in the TR District. The remaining forty percent of the total lot area shall be landscaping as defined in Section 18.62.130. Section 4 That Section 18.38.050 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.38.050 Yards. Every lot in the TR District shall have the following minimum yards: Front Yard . . . . 35 feet;* Rear Yard . . . . 25 feet; * Side Yard . . . . 25 feet;* *AII yards fronting on public or private streets shall be a minimum of thirty-five feet. Front, rear, and side yard requirements shall be increased three feet for each additional five thousand square feet over a total gross floor area of twenty-five thousand square I feet, up to a maximum requirement of forty feet for rear and side yards and fifty feet for front yards. Section 5 That Section 18.38.060 of the Bozeman Municipal Code be and the same is hereby amended as follows: 18.38.060 Building Height. The maximum building height in the TR District shall be thirty-two feet. ORDINANCE NO. 1199 lOG .. Section 6 That Table A of Section 18.62.190 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.62.190 Number of Parking and Loading Spaces Required for Specific Use. This ordinance does not affect rights and duties that matured, penalties that were in- curred or proceedings that were begun before the effective date of this ordinance. Section 8 Severability. If any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
