HomeMy WebLinkAboutOrdinance 86- 1198 Rezone (3) 103 " ORDINANCE NO.'1198 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE ZONING DISTRICT DESIGNATION FROM "PLI" (PUBLIC LANDS AND INSTITUTIONS) DISTRICT TO "TR" (TECHNOLOGY RESEARCH) DISTRICT AND "B-l" (NEIGHBORHOOD BUSINESS) DISTRICT A TRACT OF LAND BEING A PORTION OF TRACTS A AND C OF CERTIFICATE OF SURVEY NO. 1243, SITUATED IN THE N 1/2 OF SECTION 14, T2S, R5E, I MPM, IN THE CITY OF BOZEMAN, MONTANA. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: WHEREAS, the proposed zone map amendment has been properly submitted, reviewed and advertised in accordance with the procedures of Title 18 of the Bozeman Municipal Code; and WHEREAS, the Zoning Commission held a public hearing on December 18, 1984, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission held a public hearing on January 7, 1985 to receive and review all written and oral testimony on the request for a zone map amendment and continued the hearing which was advertised and brought back to the Commission on January 27, 1986; and WHEREAS, the City Commission has reviewed and considered the seven zone change criteria set out in the Planning Staff Report dated December 18, 1984, and found the proposed zone map amendment to be in compliance with the seven criteria; and WHEREAS, the City Commission has found that the proposed zone map amendment is in general compliance with the Bozeman Area Master Plan and is in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That the zoning district designation of the following described property shall be and is hereby changed from the "PLI" (Public Lands and Institutions) District to the IITR" (Technology I Research) District: A tract of land being a portion of Tracts A & C of Certificate of Survey No. 1243, situated in the N. 1/2 of Section 14, T.2S., R.5E., P.M.M., Gallatin County, Montana, and being further described as follows: Beginning at a point which is N89041 '54"W a distance of 528.91 feet from the N.E. corner of Section 14, T.2S., R.5E., P.M.M., said point also being on the north line of said Section 14; thence from said true point of beginning along the approximate centerline of an existing waterway SOoo18'06"W a distance of 70.00 feet, S09039'15"E a distance of 153.31 feet, SOl028'59"W a distance of 468.34 feet, S05008137"W a distance of 436.89 feet and S13013'47"E a distance of 210.78 feet to a point on the north 1/16 line of Section 14; thence along said line N89050'41"Wa distance of 1119.39 feet; thence NOOo09'19"E a distance of 477.51 feet; thence N89050141"W a distance of 251.78 feet; thence along a curve to the left with a radius of 1020.00 feet a distance of 155.57 feet; thence S81025100"W a distance of 245.37 feet; thence SOOo10'01W a distance of 428.39 feet to a point on the north 1/16 line of Section 14; thence along said line N89050141"W a distance of 379.98 feet to the C-N 1/16th corner of said Section 14; thence continuing along said north 1/16th line S89()53'58"W a distance of 1083.33 feet; thence NOOo07139"E a distance of 781.47 feet; thence N73023'41"E a distance of 129.32 feet; thence N8105313311E a distance of 508.58 feet; thence N75040'31"E a distance of 471.76 feet to the S. W. corner of the Farmer's Canal right-of- way; thence along the south and east line of said right-of-way S89041 '54"E a distance of 30.00 feet and NOOol0'01I1E a distance of 330.00 feet to a point on the north line of Section 14; thence along said line S89041'54"E a distance of 2092.58 feet. Said parcel containing 80.0556 acres. Section 2 That the zoning district designation of the following described property shall be and is I hereby changed from the "PLI" (Public Lands and Institutions) District to the "B-l11 (Neighbor- hood Business) District: A tract of land I?eing a portion of Tract C of Certificate of Survey No. 1243, situated in the N.E. 1/4 of Section 14, T.2S., R.5E., P.M.M., Gallatin County, Montana, and being further described as follows: Beginning at a point which is S62029'07"W a distance of 1831.91 feet from the N.E. corner of Section 14, T.2S., R.5E., P.M.M., thence from said true point of beginning SOOo09'1911W a distance of 477.51 feet to a point on the N. 1/16 line of said Section 14; thence along said line N89050'41 "W a distance of 649.35 feet; thence NOOol0'01I1E a distance of 428.39 feet; thence N81025'001lE a distance of ORDINANCE NO. 1198 104 245.37 feet; thence along a curve to the right with a radius of 1020.00 feet a distance of 155.57 feet; thence S89050141"E a distance of 251.78 feet to the point of beginning.
