ORDI NANCE NO. 1193
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE ZONING DISTRICT DESIGNATION FROM AN "R-4"
(RESIDENTIAL--MEDIUM DENSITY APARTMENTS) DISTRICT TO A "B-2"
(COMMUNITY HIGHWAY BUSINESS) DISTRICT ON A PARCEL OF LAND
DESCRIBED AS THE NORTH 421 OF THE WEST ONE-HALF OF LOT 7, THE
NORTH 42' OF LOTS 8, 9, and 10, THE WEST 42' OF THE EAST 84' OF LOTS 24
I AND 28, AND THE WEST 561 OF LOTS 24 AND 28, BLOCK E, TRACY'S THIRD
ADDITION TO THE CITY OF BOZEMAN, MONTANA.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
WHEREAS, the proposed zone map amendment has been properly submitted, reviewed and
advertised in accordance with the procedures of Title 18 of the Bozeman Municipal Code; and
WHEREAS, the Zoning Commission held a public hearing on October 22, 1985, to receive
and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission held a public hearing on November 18, 1985, to receive
and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment
to be in compliance with the twelve criteria; and
WHEREAS, the City Commission has found that the proposed zone map amendment would,
due to the public facilities and services available, the approximate location of business and the
size, scale and character of the existing neighborhood, be in the public interest.
NOW, THEREFORE, BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
I That the zoning district designation of the following described property shall be and is
hereby changed from the "R-4" (Residential--Medium Density Apartments) District to a II B-2"
(Community Highway Business) District:
THE NORTH 42' OF THE WEST ONE-HALF OF LOT 7, THE NORTH 42' OF
LOTS 8, 9, and 10, THE WEST 42' OF THE EAST 84' OF LOTS 24 AND
28, AND THE WEST 56' OF LOTS 24 AND 28, BLOCK E, TRACY'S THIRD
ADDITION TO THE CITY OF BOZEMAN, MONT ANA, ALL AS FI LED AND
OF RECORD IN THE OFFICE OF THE OFFICE OF THE GALLATIN
COUNTY CLERK AND RECORDER, MONTANA.
PROVISIONALL Y PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, this 9th day of December 1985.
