HomeMy WebLinkAboutOrdinance 85- 1188 Amends §§ 10.32.240 and 10.32.340, stopping, standing and parking U71 ORDINANCE NO. 1188 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 10.32.240 AND 10.32.340 OF THE BOZEMAN MUNICIPAL CODE PROVIDING FOR THE ESTABLISHMENT OF PARKING REGULATIONS ON ANY STREET AND APPLYING A VEHICLE OWNER'S RESPONSIBILITY TO ALL PARKING RESTRICTIONS IMPOSED BY CHAPTER 10.32 OF THE BOZEMAN MUNICIPAL CODE. I PREAMBLE The purpose of the amendment of Section 10.32.240 is to clarify general authority in the Director of Public to erect signs controlling parking on any street or highway. In addition, this ordinance extends the application of Section 10.32.340 to those parking restrictions imposed on places other than streets, highways or city-operated parking lots. BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Section 10.32.240 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 10.32.240 Parking--limitations on Certain Streets. A. The Director of Public Safety is authorized to erect signs or markings upon either or both sides of any street or highway to prohibit the standing or parking of vehicles or to restrict such standing or parking. B. When official signs are erected in each block or markings are placed along a street or highway indicating that parking is prohibited or restricted, no person shall park any vehicle in violation of any such sign or marking. I Sect ion 2 That Section 10.32.340 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 10.32.340 Illegal Parklng--Vehicle Owner Responsibility. If any vehicle is found in violation of this chapter or any rule, regulation, sign or marking in force pursuant thereto, controlling stopping, standing or parking of vehicles, any person in whose name such vehicle is registered shall be responsible for such violation. Sect ion 3 Savings Provision This ordinance does not affect right and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Sect ion 4 Severability I I f any provision of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and the applicability thereof to other persons and circumstances shall not be affected thereby.
