ORDINANCE NO. 1186
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING SECTIONS 5.06.055, 5.56.130 AND 5.56.140 OF
THE BOZEMAN MUNICIPAL CODE, REVISING THE FEES AND SPECIFYING
THE REQUIREMENT FOR BUSINESS LICENSES ISSUED PURSUANT TO
THE "BINGO AND RAFFLES ACT."
I PREAMBLE
The purpose of this ordinance is to clarify the intention of the City that
the licensing of keno games, bingo games and raffles shall apply only
when those games are conducted on premises which shall also have been
licensed for the sale of liquor, beer, food, cigarettes or any other
consumable products as authorized by Section 23-5-421, M.C.A.
BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
That Section 5.06.055 of the Bozeman Municipal Code as set out in Ordinance No. 1181
be and the same is hereby amended to read as follows:
Sect ion 1
5.06.055 Bingo, Keno and Raffles.
A. The annual license license fee for bingo and keno games under the Bingo and Raffles
Law, as limited in number by Section 5.56.146, shall be as follows per business locat ion:
1. Keno game $500
2. Bingo game $ 250
B. The temporary license fee for games of chance under the Bingo and Raffles Law shall be
as follows:
1. Keno game $25 "per day
I 2. Bingo game $ 25 per day
3. Raffles $ 25 each
Section 2
That Section 5.56.130 of the Bozeman Municipal Code be and the same is hereby amended
to read as follows:
5.56.130 Issuance under Bingo and Raffles Law--Licenses.
Any person seeking to conduct a game of chance pursuant to the Bingo and Raffles Law
on premises which have been licensed for the sale of liquor, beer, food, cigarettes or any
other consumable products, shall pay a fee as required in Chapter 5.06. An annual license
fee shall be due and payable on the first day of July of each year. An annual license fee
shall be prorated on a monthly basis for applicants who apply after July 31 and who were not
licensed during the license year immediately preceding.
Sect ion 3
That Section 5.56.140 of the Bozeman Municipal Code be and the same is hereby amended
to read as follows:
5.56.140 Raffles--Special Provisions.
I The following information must be specified in a raffle license application:
A. The date upon which the raffle is to conclude with award of prizes which shall not be
less than thirty (30) days nor more than ninety (90) days from the first day chances to
participate were offered for sale; and
B. The proposed prizes and the value of each.

Sect ion 4
Savings Provision
This ordinance does not affect right and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 5 I
Severability
If any provision of this ordinance is declared unconstitutional, or the applicability
thereof to any person or circumstances is held invalid, the constitutionality of the remainder
of the ordinance and the applicability thereof to other persons and circumstances shall not be
affected thereby.
