HomeMy WebLinkAboutOrdinance 85- 1183 Amends 8 18.62.130, zoning J43 ORDINANCE NO. 1183 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTION 18.62.130 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR LANDSCAPING DESIGN STANDARDS IN REQUIRED OFF-STREET PARKING AREAS IN THE CITY OF BOZEMAN, MONTANA. I BE IT ORDAI NED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Section 18.62.130 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.62.130 Design Staridards--Landscaping. A. Definition: For the purpose of this section, the following definitions shall apply: 1. "Access drive" means a private roadway providing a physical entrance to a property. 2. "Gross parking lot area" means the area of all parking spaces and traffic aisles. Access drives shall not be considered a part of the gross parking lot area. 3. "Landscaping" means any combination of living plants, such as trees, shrubs, vines, ground covers, flowers or lawns; and may include natural features such as decorative rock, stone and bark, and structural features including, but not limited to, fountains, reflecting pools, art works, screen walls, fences and benches. 4. "Traffic aisle" means a traveled way by which cars enter and depart parking I spaces. B. Required Yards: Not less than 75 percent of all required minimum front, side, and rear yards on abutting streets or avenues, shall be landscaped as follows: 1. At least 75 percent of the landscaped yards shall have live, vegetative ground cover of grass or other plant materials; 2. As an alternative to live vegetation, the remainder may be covered with rock, stone, bark, etc., and other ornamental features; 3. Except, however, a lot meeting the minimum lot width requirement of the district in which it is located may be permitted one (1) access drive, provided that the additional landscaping necessary to satisfy the 75 percent landscaping requirement is located in an area directly adjacent to the landscaped yard. C. Interior Parking Lot Landscaping: Any parking lot providing more than 15 parking spaces shall have, in addition to required yard landscaping, a minimum of six percent (6%) of the interior of the gross parking lot landscaped as follows: 1. At least 75 percent of the interior parking lot landscaping shall have live, vegetative ground cover of grass or other plant materials; I 2. As an alternative to live vegetation, the remainder may be covered with rock, stone, bark, and other Impermeable features, but may not Include access drives, traffic aisles, parking spaces or sidewalks. 3. All required Interior parking lot landscaping shall be located within the gross parking lot area. In no case shall such landscaping be provided as additional front, side or rear yards. Wherever possible, the interior parking lot landscaping ORDINANCE NO. 1183 U41t shall be utilized to facilitate, control and denote proper vehicular circulation patterns. 4. In order to encourage the proper dispersion of the required interior parking lot area landscaping, no required interior landscaping area shall be larger than 200 square feet (see Figure 5). The minimum width of any landscaped area I shall be five feet (see Figure 6). Except, however, the Planning Director may waive either the 200 square feet maximum landscape size requirement or the five-foot minimum width requirement, or both, if: a. the internal parking lot landscaping provided is properly dispersed; and b. the granting of the waiver and the resulting parking lot and landscaping design: 1. establish improved vehicular circulation patterns; or 2. establish improved parking lot drainage; or 3. achieve better screening or other aesthetic purposes. D. Trees: Trees shall be a major design element in all parking lots and shall include a minimum of one (1) tree per three (3) parking spaces or fraction thereof. Tree size shall be a minimum of one and one-half (1 1/2) inch in caliper for deciduous trees or a minimum of four (4) feet in height for coniferous trees. E. Maintenance: All landscaped areas shall be properly maintained at all times, kept free of weeds, and in continuous healthy growth. A water irrigation system to sustain all live landscape plantlngs shall be provided. I F. Plan Approval: All landscaping plans for parking lots providing more than fifteen parking spaces and/or required screening plans shall be approved by the Planning Director prior to the issuance of a building permit. PREAMBLE I The purpose of this amendment is to expand the rules and regulations for the operation of the sewage disposal system in compliance with the Environmental Protection Agency.
