SUBJECT: Resolution 4698, Approving Change Order No. 1 for the 2016 Downtown
& North 7th Conduit Project

RECOMMENDATION: Approve Resolution 4698, a change order for the 2016 Downtown &
North 7th Conduit Project.
BACKGROUND: Attached is a copy of change order number 1 for the above referenced
project. This change order includes the addition of 2,860 linear feet of fiber optic conduit and 7
maintenance holes to further expand the city’s fiber optic network. A description of the work and a spreadsheet of the quantities are included with the change order documents. Overall this change will increase the contract price by $117,220.49 and the contract time by 14 days. The final
recommended change in cost and time for these items is reasonable and commensurate with the
work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order increases the contract amount by $117,220.49
from $713,000.63 to $830,221.12 and will be paid for with approved funding from the Midtown
and Downtown Urban Renewal District Funding as follows:
Downtown Urban Renewal District Fund: $90,246.22 Midtown Urban Renewal District Fund: $26,974.27

CHANGE ORDER INSTRUCTIONS A. GENERAL INFORMATION This document was developed to provide a uniform format for handling contract changes that affect Contract Price
or Contract Times. Changes that have been initiated by a Work Change Directive must be incorporated into a
subsequent Change Order if they affect Price or Times.
Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order. The practice of accumulating Change Orders to reduce the administrative burden may lead to unnecessary disputes.
If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be addressed.
For supplemental instructions and minor changes not involving a change in the Contract Price or Contract Times, a
Field Order should be used.
B. COMPLETING THE CHANGE ORDER FORM
Engineer normally initiates the form, including a description of the changes involved and attachments based upon
documents and proposals submitted by Contractor, or requests from Owner, or both.
Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for approval, depending on whether the Change Order is a true order to the Contractor or the formalization of a negotiated
agreement for a previously performed change. After approval by one contracting party, all copies should be sent to
the other party for approval. Engineer should make distribution of executed copies after approval by both parties.
If a change only applies to price or to times, cross out the part of the tabulation that does not apply.

REVISED, CHANGE ORDER REQUEST: Conduit & Vaults, 2016 Downtown/North 7th Conduit
Saunders Line Construction, Inc. is requesting a change order based on additional quantities
associated with revisions 2 thru 5 of the 2016 Downtown & N. 7th Conduit Project.
The additional conduit and vaults needed, will be supplied on a cost plus 10% and is shown on
the attached spread sheet.
The labor and equipment is being charged using the exact same equipment and production
rates as used in the original bid.
Building entrance at 777 Broadway has been added to this C/O request.

COMMISSION RESOLUTION NO. 4698
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH SAUNDERS LINE CONSTRUCTION INC., CHENEY, WASHINGTON.
WHEREAS, the City Commission did, on the 25th day of March 2016, authorize award of the bid
for the 2016 Downtown & North 7th Conduit Project, to Saunders Line Construction, Inc., Cheney,
Washington; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and Saunders Line Construction, Inc., as contained in Change Order No. 1, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed
to attest such signature.
