ORDINANCE NO. 1177
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTION
18.42.040 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR DEVELOPMENT
AND PERFORMANCE STANDARDS IN THE TRANSITIONAL DISTRICTS.
WHEREAS, an amendment to the Zoning Ordinance of the City of Bozeman was submitted, I
reviewed and advertised in accordance with the procedures of Chapter 18.68 of the ordinance;
and
WHEREAS, the Bozeman City Zoning Commission held a public hearing on February 26,
1985, and recommended to the Bozeman City Comm ission that the amendment be approved; and
WHEREAS, the Bozeman City Commission held a public hearing on March 18, 1985, and,
on April 1, 1985, decided to amend the Zoning Code to allow properties in Transitional
Districts to develop through the Planned Unit Development procedure as well as the
Conditional Use procedure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:
That Chapter 18.42.040 of the Bozeman Municipal Code be and the same is hereby
amended to read as follows:
18.42.040 Development and Performance Standards. I
The zoning commission recommendation of a particular T district to the city commission
shall include specific development standards and may include performance standards. The T
districts and specific standards for each T district shall be adopted concurrently by the city
commission. Such specific standards may provide for:
A. Receiving a conditional use permit as provided in Chapter 18.52 or a planned unit
development permit in accordance with the conditional use permit procedure as provided
in Chapter 18.54 (mandatory):
B. Special setbacks, yards, open spaces and buffers;
C. Fences and walls;
D. Lighting;
E. Regulations of vehicular ingress and egress;
F. Regulations of signs;
G. Regulation of time of certain activities;
H. Landscaping and maintenance thereof;
I. Time schedule of proposed development;
J. Regulation of odors, smoke, dust, airborne particles, vibration, glare, heat and noise; I
K. Such other reasonable conditions to protect surrounding areas and provide for orderly
compatible development.
PROVISIONALLY PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, this 8th day of April , 1985.
