HomeMy WebLinkAboutOrdinance 84- 1162 Amends §8 18.30.020, 18.32.020 and 18.52.140, zoning 459 ORDINANCE NO. 1162 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA, AMENDING SECTIONS 18.30.020,18.32.020 AND 18.52.140 OF THE BOZEMAN MUNICIPAL CODE, BY REMOVING BARS, TAVERNS AND COCKTAIL LOUNGES FROM THE LIST OF PERMITTED USES AND ADDING I THEM TO THE LIST OF CONDITIONAL USES IN BOTH THE B-2 and B-3 ZONES IN THE CITY OF BOZEMAN, MONTANA. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Section 18.30.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.30.020 Permitted Uses. Permitted uses in the B-2 district are as follows: 1. Ambulance service; 2. Antique shops; 3. Art and music supply stores; . 4. Barber and beauty shops; 5. Bowling alleys; 6. Ca r washes; 7. Churches; 8. Conditional uses provided in Chapter 18.52; I 9. Equipment sales and service; 10. Financial institutions; 11. Fire stations; 12. Food stores and drugstores; 13. Frozen food storage and locker rental; 14. Furniture stores; 15. Hotels and motels; 16. Gasoline service stations; 17. Laundries and drycleaning establishments; 18. Liquor stores; 19. Mortua ries; 20. Post offices; 21. Professional and business offices; 22. Research and development institutions; 23. Restaurants, cafes and drive-in eating establishments; 24. Signs; I 25. Sporting goods stores; 26. Temporary buildings, for and during construction only; 27. Theaters, except drive-in theaters; 28. Uses customarily accessory to those listed herein; 29. Vehicles and boat sales, showrooms and service areas; 30. Veterinary clinics; ORDINANCE NO. 1162 ~~-~- -- 46'0 31. Upholstery shops (excluding on-site upholstery service for cars, boats, trailers, trucks and other motorized vehicles requiring overnight storage); 32. Wholesale establishments that use samples, but do not stock on premises. I Section 2 That Section 18.32.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.32.020 Permitted Uses. Permitted uses in the B-3 district are: 1. Ambulance service; 2. Apartments; 3. Bakeries; 4. Barber and beauty shops; 5. Butcher shops (retail sales only); 6. Churches; 7. Conditional uses as provided in Chapter 18.52; 8. Dressmaking; 9. Financial institutions; I 10. Fi re stations; 11. Handicraft manufacturing (retail sales only); 12. Health and exercise establishments; 13. Hotels and motels; 14. Laundry, drycleaning and laundromats; 15. Meeting and lodge halls; 16. Museums, libraries, and galleries; 17. Parking lots; 18. Photo studios; 19. Printing offices and publishing establishments; 20. Private schools, such as dance, business secretarial and technical, but not private or public pre-school, elementary or secondary schools; 21. Professional and business offices (for personal services); 22. Public offices; 23. Repair services for clothes, dolls, small appliances, watches, glasses, and such other item s ; I 24. Restaurants and cafes; 25. Retail sales, which would include but not be limited to: a. Clothing; b. Food; c. Furniture; ORDINANCE NO. 1162 ---. -~ 461 d. Hardware; e. Jewelry; f. Novelties; g. Office supplies; I h. Pharmaceuticals; but excluding heavy machinery. Please refer to Section 18.04.460 for the definition of retail sales; 26. Signs; 27. Temporary buildings for and during construction, only; 28. Theaters, except drive-ins; 29. Uses customarily accessory to those listed; 30. Upholstering shops (excludes on-site upholstering services of cars, boats, trucks, and other heavy equipment); 31, Wholesale establishments that use samples, but do not stock on premises. Section 3 That Section 18.52.140 of the Bozeman Municipal Code as amended by Ordinance No. 1144, finally passed on October 17, 1983, be and the same is hereby amended as follows: 1 8 . 52 . 1 40 Conditional Uses Designated for I ndividual Zoning Districts. The following uses may be permitted as conditional uses in the districts as specified: I A. AS Agriculture Suburban District. Public and private parks and playgrounds; golf courses and country clubs; hunting and fishing clubs; schools and travel trailer parks; and television and radio broadcasting studios and transmitters; ambulance service and public utility facilities; and one-family mobile homes on permanent foundations which meet all requirements of Section 18.50.220 as well as the requirements of this chapter. B. RS Residential Suburban District. Schools (non-board, nursery, elementary, junior and senior high); public and private parks and playgrounds; golf courses and country clubs; other recreational uses; FCC earth stations; PUD's as provided in Chapter 18.54 of this title; ambulance service and public utility facilities; C. R-1 Single-Fami Iy Residential--Low-Density District. Schools; libraries; public and private parks and playgrounds; golf courses and country clubs; PUD's as provided in Chapter 18.54 of this title; ambulance service and public utility facilities; I D. R-2 Single-Family Residential--Medium-Density District. Same as R-1 district; E. R-3 Residential--Medium-Density District. Conditional uses provided in the R-1 and R-2 districts that are not permitted uses in the R-3 district, as provided in Chapter 18.58 of this title; PUD's as provided in Chapter 18.54 of this title; fraternity and sorority hou ses ; and med ica I offices; ORDINANCE NO. 1162 462 F. F-4 Residential--Medium-Density Apartment District. Same as R-3 district; G. R-5 Residential--High-Density District. Same as R-4 district; H. R-MH Residential--Mobile Home. Public utility facilities; I I. R-O Residential--Office District. Nursing homes and hospitals; churches; public and private parks and playgrounds; other types of medical facilities or personal services not listed as a permitted use; PUD's as provided in Chapter 18.54 of this title; and ambulance service and public utility facilities; J. B-1 Neighborhood Business District. Retail uses in addition to those permitted uses listed, but limited to those serving the customer directly; gasoline service stations; and professional and business office uses; K. B-2 Community--Highway Business District. Retail uses in addition to those permitted uses listed; bars, taverns and cocktail lounges; wholesale distributors with on-premises retail outlets, provided warehousing is limited to commodities which are sold on the premises; amusement and recreational activities; shopping centers; travel trailer parks as provided in Chapter 18.60 of this title; residence for owner or caretaker; PUD's as provided in Chapter 18.54 of this title; and public utility facilities; I L. B-3 Central Business District. Amusement and recreation activities; auction rooms; bars, taverns and cocktail lounges; transportation and utilitY stations; drive-in banks and cleaners; radio and TV broadcasting and transmitting studios, civic centers; service stations and auto service centers, car washes (hand operated), auto upholstery shops, auto body shops, muffler sales and service shops; sign paint shops (not neon sign fabrication); and planned unit developments as provided in Chapter 18.54; M. M-1 Commercial--Light Manufacturing District. Amusement and recreational activities; open storage (if adequately screened); retail establishments (in addition to those listed in Chapter 18.34); residences for owner or caretaker; PUD's as provided in Chapter 18.54 of this title; animal shelters and veterinary clinics; N. M-2 Manufacturing and I ndustrial District. Junk salvage yards (if adequately screened); residences for owner or caretaker; O. TR Technology Research District. Other research establishments not listed as permitted I uses, planned research establishments as provided in Chapter 18.54 of this title; P. PLI Public Lands and Institutions.
