ORDINANCE NO. 1159
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING SECTIONS 5.06.050 AND 5.56.100 OF THE BOZEMAN
MUNICIPAL CODE, ESTABLISHING THE FEE STRUCTURE FOR LICENSES
ISSUED PURSUANT TO THE MONTANA CARD GAMES ACT OR THE BINGO AND
RAFFLES ACT AND SETTING THE LIMITATION ON THE NUMBER OF CARD
GAME TABLES PER BUSINESS LOCATION IN THE CITY OF BOZEMAN,
MONTANA. I
PREAMBLE
The purpose of this ordinance is to amend Section 5.06.050 previously entitled
Gaming--Bingo and Raffles and Section 5.56.100, previously entitled Issuance
under Montana Card Games Act--Fees--Payment to remove all references to poker
machines in view of the Montana Supreme Court's decision disallowing their use
and to clarify the license fees for card games and keno machine games.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That Section 5.06.050 of the Bozeman Municipal Code be and the same is hereby
amended to read as follows:
5.06.050 Card Games--Bingo and Raffles.
A. The license fee for card game tables for playing bridge, cribbage, hearts,
panguingue, pinochle, pitch, rummy, whist, solo and poker when the prize is
money or any item of value, as limited in Section 5.56.100, shall be as follows:
1. First Table $ 500
2. Second Table $ 500
3. Third Table $ 750 I
4. Fourth Table $1,000
B. The license fee for card game tables for playing bridge, cribbage, hearts,
panguingue, pinochle, pitch, rummy, whist, solo and poker solely for the
amusement of the players shall be $50 per table.
C. The license fee under the Bingo and Raffles Law, as set forth in Section 5.56.130
shall be $250 per business location per year, with the following exceptions:
1. Electronic Keno Machines $500 per machine
location per year.
2. Keno Game $500 per business
location per year.
3. Temporary licenses pursuant to Section 5.56.140.
a. Locations licensed under
subparagraph A, above $25 per business
location per day.
b. Others $25 or five percent I
of the actual value
of prices to be
awarded, whichever
is larger.

Section 2
That Section 5.56.100 of the Bozeman Municipal Code, be and the same is hereby
amended to read as follows:
5.56.100 I ssuance under Montana card games act--payment.
I Each person obtaining a license for the operation of a card table under the
Montana Card Games Act must, in addition, possess a city license for the sale of liquor,
beer, or a business license which includes the sale of food, cigarettes or any other
consumable products. Each person desiring a license to operate one or more card tables
shall pay a per table annual license fee, as set forth in Section 5.06.050. At no time,
however, shall any business location be licensed to operate more than a total of four
card game tables when the prize is money or any item of value. Such license fee shall
be due and payable on the 30th day of June of each year. Failure to pay the license
fee on or before the time stated shall result in the revocation of the license.
PROVISIONALL Y PASSED AND ADOPTED by the City Commission of the City of
Bozeman, Montana, this 26th day of March 1984.
