HomeMy WebLinkAboutOrdinance 84- 1153 Adds 8 18.50.220, zoning 441 ORDINANCE NO. 1153 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING TITLE 18 OF THE BOZEMAN MUNICIPAL CODE, BY AMENDING SECTION 18.50.220, PROVIDING FOR CERTAIN LIMITA- TIONS IN THE WATER COURSE SETBACKS. I BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: That Section 18.50.220 be and the same is hereby added to the Bozeman Municipal Code to read as follows: 18.50.220 Water Course Setbacks. No newly constructed structure, addition to an existing structure, parking lot or other similar improvements shall be located closer than thirty-five feet to the mean high water mark of the stream. For the purpose of this regulation, the mean high water mark shall be defined as the line which the water impresses on the soil by covering it for sufficient periods to deprive it of vegetation. A minimum of five feet of the required thirty-five foot setback immediately adjacent to the stream shall be left in a natural vegetative state. PROVISIONALLY PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, this 30th day of January 1984.
