AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, N1ENDP1GTHE NATURE OF
THE COMMISSION-MANAGER FORM OF GOVERNMENT BY ADOPTING SELF-GOVERNMENT
POWERS: PROVIDE FOR SUBMITTING THE QUESTION OF AMENDMENT TO THE ELEC-
TORS; AND PROVIDE FOR AN EFFECTIVE DATE.
PRE A M B L E
The purpose of this ordinance is to amend the existing Commission- I
Manager form of government with general government powers to a
Commission-Manager form of government with self-government powers
under Sections 7-3-101 and 7-3-302(2), M.C.A. 1981.
WHEREAS, Article XI, Section 6 of the Montana Constitution provides that a local
government unit with self-government powers may exercise any power not prohibited by the
Constitution, law or charter. These powers include, but are not limited to, the powers
granted to general power governments.
WHEREAS, a local government with self-government powers may provide any services
or perform any functions not expressly prohibited by Montana Constitution or state law.
Those services and functions include but are not limited to those services and functions which
generalpowe~ government units are authorized to provide or perform.
l'IHEREAS, self-government powers will better enable the City to act in its own best
interest by giving it more flexibility to respond to local situations.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:
Section 1
That the nature of the Commission-Manager form of government in the City of Bozeman,
Montana, is hereby amended to enact self-government powers. I
Section 2
That this ordinance shall be submitted to the electors of the City of Bozeman,
Montana, for ratification at the November 8, 1983 general election for election of municipal
officials.
Section 3
That this ordinance shall be in full force and effect from and after thirty (30)
days after its ratification by the electors.
PROVISIONALLY PASSED AND ADOPTED at the regular meeting of the City Commission of
the City of Bozeman held on this 29th day of August 1983.
