ORDINANCE NO. 1133
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THE ALLEY IN TRACT 1
OF THE NORTH SEVENTH ADDITION IN THE CITY OF BOZEMAN, MONTANA.
WHEREAS, certain property owners of property abutting the hereinafter described
I alley in Tract 1 of the North Seventh Addition to the City of Bozeman, Montana, have
presented to the City Commission a petition requesting vacation of said alley; and
WHEREAS, the City Commission of the City of Bozeman, Montana, on the 31st day
of r~ay, 1983, at its regular meeting passed and adopted Commission Resolution No. 2455
declaring it to be the intention of the City Commission of the City of Bozeman, to
vacate the following alley:
That alley in Tract 1 of the North Seventh Addition to the City of
Bozeman, Montana.
WHEREAS, notice of the adoption of said resolution was published in the Bozeman
Daily Chronicle at least once, to wit, on the 3rd day of June 1983, as appears from the
affidavit of publication of the publiSher of said Bozeman Daily Chronicle, which is on
file with the Clerk of the City Commission of the City of Bozeman; and
WHEREAS, said notice of the adoption of said resolution has been served in the
manner of the service of summons in civil actions upon all persons whose property abuts
upon the portion of the above described alley affected by the proposed vacation, which
said notice designated the 6th day of June 1983 at 4:00 o'clock p.m., at the Commission
I Room in the City Hall Building, Bozeman, Montana, as the time and place for hearing
objections; and
WHEREAS, on the 6th day of June 1983, at its regular meeting the City Commission
fully heard objections to and evidence in support of said vacation.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That the following alley be vacated, to wit:
All that alley in Tract 1 of the North Seventh Addition to the City
of Bozeman, as filed and of record in the office of the Clerk and
Recorder of Ga 11 at in County, Montana.
Section 2
This ordinance shall be in full force and effect from and after thirty (30) days
after its final adoption.
PROVISIONALLY PASSED AND ADOPTED at the regular meeting of the City Commission
of the City of Bozeman held on this 13th day of June 1983.
