HomeMy WebLinkAboutOrdinance 83- 1130 Amends Ch. 2.28, city judge ,328 ORDINANCE NO. 1130 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 2.28 OF THE BOZEMAN MUNICIPAL CODE TO PROVIDE FOR THE OFFICE OF CITY JUDGE. PRE A M B L E Chapter 2.28 is currently entitled Municipal Judge. The City of Bozeman does not wish to establish a municipal court, but rather a city court I in accordance with state law. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: That Chapter 2.28 of the Bozeman Municipal Code be and the same is hereby amended to read as foll ows: CITY JUDGE 2.28.010 Office of City Judge There is hereby established the office of City Judge for the City of Bozeman. 2.28.020 Method of Selection and Term of Office A. The person holding the office of City Judge shall be elected at a general election. Names of candidates for the office shall be placed on the ballot without party designation. B. An elected City Judge shall hold office for a term of four years. A City Judge shall continue to hold office until the qualification of a successor. 2.28.030 Qualifications A. Residency Requirements. 1- A person filing for election or holding the office of City Judge for a I portion of or the whole of any term shall be a citizen of the United States of America. Such person shall also have continuously and un- interruptedly maintained a domicile and residence in the state of Montana for two calendar years prior to filing for election with the County Clerk and Recorder. 2. An applicant for the position of City Judge must, at the time of filing for election, have continuously and uninterruptedly maintained a residence and domicile within the corporate jurisdictional limits of the City of Bozeman for a period of one year. 3. Any person elected or holding the office of City Judge must maintain a domicile and residence within the corporate jurisdiction of the City of Bozeman during the term of office. B. Admission to Bar. An applicant for the office of the City Judge must be admitted to practice law in the state of Montana for a period of two calendar years prior to filing for election with the County Clerk and Recorder. I 2.28.040 Compensation and Exoenses The annual salary of the City Judge shall be established by ordinance. In addition to the salary, the City Judge shall receive actual and necessary travel expenses incurred in performing official duties as provided by state law. ORDINANCE NO. 1130 -~ 329 2.28.050 Powers and Duties The City Judge shall have those powers and duties as are provied by state law. 2.28.070 Deposit of Funds A. All monies, from whatever source, collected under the jurisdiction of the I City Judge shall be deposited and managed in accordance with the applicable rules of the Montana Supreme Court. B. So long as the rules of the Montana Supreme Court do not require otherwise, all such monies shall be deposited daily with the treasurer of the City of Bozeman as directed by the Director of Finance of the City of Bozeman. C. In order to establish an appropriate control of monies deposited temporarily for bonds, appearance bonds, etc., there is hereby created a trust fund into which all such monies shall be placed. Upon final disposition of the matter to which such a bond pertains by the City Court, such monies shall be disbursed from the trust fund according to the direction of the City Judge. 2.28.080 Vacancy Filled by Commission Should a vacancy occur in the office of City Judge, the City Commission shall appoint a qualified individual to serve for the remainder of the term.
