HomeMy WebLinkAboutOrdinance 82- 1116 Adds prior code §§ 11.12.010--11.12.090, handicapped parking 288 ORDINANCE NO. 1116 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN LIMITING THE USE OF DESIGNATED HANDICAP PARKING STALLS AND PROVIDING PENALTY FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COMMISSION of the City of Bozeman, Montana, as follows: SECTION 1 I Chapter 11.12 GENERAL PROVISIONS 11.12.010 TITLE This Ordinance shall be known and cited as the Handicap Parking Ordinance of the City of Bozeman and referred to as such in Title 11 of the Bozeman Municipal Code. 11.12.020 MINIMUM REQUIREMENTS In their interpretation and application the provisions of this Ordinance shall be held to be minimum requirements adopted as an exercise of the general police powers of the City of Bozeman for the promotion of the health, safety and welfare of the physically handicapped citizens of the community. SECTION 2 DEFINITIONS 11.12.030 PHYSICALLY HANDICAPPED One who holds a valid driver's license and owns a motor vehicle, other than I a commercial vehicle, and has a permanent physical disability that impairs their mobility when not in a motor vehicle; or regardless of whether they hold a driver's license or own a motor vehicle, have a permanent physical disability that impairs their driv;ngability and impairs their mobility when not in a motor vehicle to such an extent that they need to be driven by another person to a destination. 11.12.040 HANDICAPPED PARKING STALL A handi capped parkinq stall shall be one so des ignated by the use of the nationally recognized handicapped sign or symbol. 11.12.050 OTHER DEFINITIONS All other definitions applicable to this chapter shall be as found in Sections 11.04.010 through 11.04.085 of this Title. SECTION 3 ADMINISTRATION AND ENFORCEMENT 11.12.060 PARKING IN DESIGNATED HANDICAPPtD STALLS Pursuant to the provisions of Title 49, Chapter 4, Part 3, MCA, it shall be unlawful for anyone to park, stop or stand at a deSignated handicapped parking I stall as defined herein, whether on the pUblic right-of-way or in public parking lots, except those displaying a handicap symbol issued by the Division of Motor Vehicles or other competent jurisdiction. ORDINANCE NO. 1116 '. . 269 11.12.070 DISPLAY OF HANDICAPPED SYMBOL--PRIVILEGES Handicapped persons as defined herein shall be granted the privilege of parking at the designated handicapped locations, as listed in Section 11.12.050 above, subject to all other limitations of this Title such as time limit, parking close to I curb, etc., only when the handicapped symbol has been prominently displayed in the windshield of the vehicle. Exception: The privilege shall not be extended to those persons not disabled, displaying the handicapped symbol while they are not engaged in transporting, delivering or picking up the handicapped. 11.12.080 DUTIES OF THE POlICE DIVISION , . 'to' .., It shall be the duty of the Police Division to enforce the provisions of this Chapter, issue citations for the violation thereof, and assist in the prosecution of those persons Violating this Chapter. 11.12.090 DUTIES OF OTHER PUBLIC EMPLOYEES The provisions of this Chapter shall apply to the driver of any vehicle owned by or used in the service of the United States Government, the State of Montana, the County of Gallatin, or the City of Bozeman, and it shall be unlawful for any said driver to violate any of the provisions of this Chapter, except those vehicles designated as emergency vehicles. SECTION 4 I VIOLATION--PENALTIES Any person violating the provisions of this Chapter shall upon conviction thereof be punished by a fine of not less than Fifteen Dollars ($15) nor more than One Hundred Dollars ($100). SECTION 5 This Ordinance shall be in full force and effect from and after thirty (30) days after its adoption.
