HomeMy WebLinkAboutOrdinance 82- 1099 Amends prior code §§ 18.48.028 and 18.72.150, zoning 210 ORDINANCE NO. 1099 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 18.48.020 and 18.72.150 OF THE BOZEMAN MUNICIPAL CODE PROVIDING FOR ADDITIONS AND DELETIONS TO THE LISTING OF PERMITTED USES AND CONDI- I TIONAL USES IN THE B-3 ZONE IN THE CITY OF BOZEMAN, MONT ANA. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: SECTION 1 That Section 18.48.020 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 18.48.020 PERMITTED USES 1. Ambulance service 2. Apartments 3. Bakeries 4. Barber and beauty shops 5. Bars, cocktail lounges 6. Butcher shops (retail sales only) 7. Churches 8. Conditional uses as provided in Chapter 18.72 9. Dressmaking 10. Financial institutions ll. Fire stations 12. Handicraft manufacturing (retail sales only) 13. Health and exercise establishments 14. Hotels and motels 15. Laundry, dry cleaning and laundromats 16. Meeting and lodge halls 17. Museums, libraries, and galleries 18. Par king lots I 19. Photo studios 20. Printing offices and publishing establishments 21. Private schools, such as dance, business secretarial and technical but not private or public pre-school, elementary or secondary schools 22. Professional and business offices (for personal services) 23. Public offices 24. Repair services for clothes, dolls, small appliances, watches, glasses, and such other items 25. Restaurants and cafes 26. Retail sales, which would include but not limited to: a. clothing e. je.velry b. food f. novelt~es c. furni ture g. office supplies d. hardware h. pharmaceuticals but excluding heavy machinery. Please refer to Section 18.06.460 for the definition of retail sales. 27. Signs 28. Temporary buildings for and during construction, only 29. Theaters, except drive-ins 30. Uses customarily accessory to those listed 31. Upholstering shops (excludes on-site upholstering services of cars, boats, trucks, and other heavy equipment) 32. Wholesale establishments that use samples, but do not stock on premises. SECTION 2 That Section 18.72.150 of the Bozeman Municipal Code be, and the same is hereby amended to read as follows: I 18.72.150 CONDITIONAL USES BY ZONING DISTRICTS The following uses may be permitted as conditional uses in the districts as specified: AS Agriculture District Public and private parks and playgrounds, golf courses and country clubs, hunting and fishing clubs, schools and travel trailer parks, and television and ORDINANCE NO. 1099 . 211 radio broadcasting studios and transmitters, ambulance service and public utility facilities. RS Residential Suburban Schools (nonboard, nursery, elementary, junior and senior high), public and I private parks and playgrounds, golf courses and country clubs, other recreational uses, F.C.C. earth stations, and P.D.D.'s as provided in Chapter 18.75 of this ordinance, ambulance service and public utility facilties. R-l Single Family Residential--Low Density Schools, libraries, public and private parks and playgrounds, golf courses and country clubs, P.D.D.'s as provided in Chapter 18.75 of this ordinance, ambulance service and public utiltiy facilities. R-2 Single Family Residential--Medium Density Same as R -1 District. R-3 Residential--Medium Density Conditional uses provided in the R-l, and R-2 districts that are not permitted uses in the R-3 district, as provided in Chapter 18.78 of this ordinance, P.U.D.'s as provided in Chapter 18.75 of this ordinance, fraternity and sorority houses and medical offices. R-4 Residential--Medium Density Apartments Same as R - 3 district. R-5 Residential--High Density I Same as R-4 district. R-O Residential-Office District Nursing homes and hospitals, churches, public and private parks and playgrounds. Other types of medical facilities or personal services not listed as a permitted use, P. U. D .'s as provided in Chapter 18.75 of this ordinance, ambulance service and public utility facilities. B-1 Neighborhood Business District Retail uses in addition to those permitted uses listed but limited to those serving the consumer directly, gasoline service stations, and professional and business office uses. B-2 Community-Highway Business District Retail uses in addition to those permitted uses listed, wholesale distributors with on-premises retail outlets provided warehousing are limited to commodities which are sold on the premises, amusement and recreational activities, shopping centers, travel trailer parks as provided in Chapter 18.81 of this ordinance, residence for owner or caretaker, and P. D. D. 's as provided in Chapter 18.75 of this ordinance, and electrical substations. B-3 Central Business District Amusement and recreation activities, auction rooms, transportation and utility I stations, drive-in banks and cleaners, radio and T. V. broadcasting and transmitting studios, civic centers, service stations and auto service centers, car washes (hand operated), auto upholstery shops, auto body shops, muffler sales and service shops, sign paint shops (not neon sign fabrication) and Planned Unit Developments as provided in Chapter 18.75 of this ordinance. M-l Commercial--Light Manufacting Amusement and recreational activities, open storage (if adequately screened), OEDINANCE NO. 1099 .. 212 retail establishments (in addition to those listed in Chapter 18.51) residences for owner or caretaker, P.U.D.'s as provided in Chapter 18.75 of this ordinance, animal shelters, and veterinary clinics. M-2 Manufacturing and Industrial Junk salvage yards (if adequately screened), residences for owner or caretaker. I TR Technology Research District Other research establishments not listed as permitted uses, planned research establishments as provided in Chapter 18.75 of this ordinance. SECTION 3 This ordinance shall be in full force and effect from and after thirty (30) days after its adoption.
