ORDINANCE NO. 1098
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING
PORTIONS OF 17th A VENUE AND 18th A VENUE IN THE
CITY OF BOZEMAN. MONT ANA.
WHEREAS. certain property owners on property abutting the hereinafter described I
streets in the southwestern portion to Bozeman. Montana. having presented to the City
Commission petitions requesting vacation of said streets; and
WHEREAS. the City Commission of the City of Bozeman. Montana. on the 3rd day
of February. 1982. at its regular meeting passed and adopted Commission Resolution No.
2388 declaring it to be the intention of the City Commission of the City of Bozeman to vacate
portions of 17th Avenue and 18th Avenue south of Olive Street described as follows:
Beginning at the west 1/4 corner. a nail in the pavement.
of Section 12. Township 2 South. Range 5 East. Montana
Principal Meridian. Gallatin County. Montana; thence South
00048'19" East. along the easterly right-of-way of the
Farmers Canal. a distance of 391. 60 feet. to the true point
of beginning; thence North 89005'37" East. a distance of
821. 45 feet; thence along a curve to the right. having a
radius of 180.00 feet; and a central angle of 90043'20". an
arc distance of 285.01 feet; thence South 0001l'03" East. a
distance of 537.87 feet. to a point on the northerly right-
of-way of Koch Street; thence South 88055'46" West. along
said right-of-way. a distance of 60.01 feet; thence North
00011'03" West. a distance of 538.79 feet. thence along a
curve to the left; having a radius of 120.00 feet and a central
angle of 90043'20". an arc distance of 190.01 feet. thence
South 89005'37" West. a distance of 198.34 feet; thence I
South 00037'16" East. a distance of 332.90 feet; thence
along a curve to the right having a radius of 50.00 feet.
and a central angle of 286016'40". an arc distance of
249.82 feet; thence North 00037'16" West. a distance of
332.59 feet. thence South 89005'37" West. a distance of
329.75 feet; thence South 00037'16" West a distance of
336.38 feet; thence along a curve to the right. having
a radius of 50.00 feet. and a central angle of 286015'53".
an arc distance of 249.81 feet; thence North 00037'16"
West. a distance of 336.06 feet; thence South 89005'37"
West. a distance of 173.47 feet. to a point on the easterly
right-of-way of the Farmers Canal; thence North 00048'19"
West. along said right-ot-way. a distance of 60.00 feet to
the point of beginning and containing 3.464 acres.
WHEREAS. notice of the adoption of said resolution was published in the Bozeman
Daily Chronicle at least once. to wit. on the 27th day of January. 1982. as appears from the
affidavit of publication of the publisher ot said Bozeman Daily Chronicle. which is on file
with the Clerk of the City Commission of the City of Bozeman; and
WHEREAS. said notice of the adoption of said resolution has been served in the
manner of the service of summons in civil actions upon all persons whose property abuts
upon the above described streets proposed to be vacated and which will be affected by the
proposed vacation. which said notice designated Wednesday. the 3rd day of February. 1982. I
at 1:15 p.m.. at the Commission Room in the City Hall Building. Bozeman. Montana. as the
time and place for hearing objections; and
WHEREAS. on the 3rd day of February. 1982. at its regular meeting the City
Commission fully heard objections to and evidence in support of said vacation.

SECTION 1

SECTION 2
This Ordinance shall be in full force and effect from and after thirty (30) days
after its adoption.
PASSED AND ADOPTED at the regular meeting of the City Commission of the City
of Bozeman held on this 10th day of February 1982.
