HomeMy WebLinkAboutOrdinance 81- 1079 Amends §§ 18.84.040 and 18.84.050, zoning .l2J3 ORDINANCE NO. 1079 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 18.84.040 AND 18.84.050 OF THE BOZEMAN MUNICIPAL CODE PRO- VIDING FOR EXCEPTIONS FOR OFF-STREET PARKING RE- QUIREMENTS IN THE CITY OF BOZn1AN, MONTANA. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: I Section 1 That Section 18.84.040 of the Bozeman Municipal Code be. and the same is hereby amended to read as follows: 18.84.040 Desiqn 1. Location - Off-street parking area(s) as required by this ordinance shall be located as specified herein. A. Single-family dwellings - One the same lot with the dwelling they are required to serve. B. Multi-''farriilydwellings - On the same lot with the dwelling they are required to serve. C. Hospitals, sanitariums. townhouses, apartments, rooming and boarding houses, fraternity and sorority houses - Within 100 feet of the use to be served and located in the same district as the principal use. D. Commercial and industrial uses - Within 400 feet of the use they are required to serve and located in the same district as the principal use. Where a distance is specified. such distance shall be measured by a straight line from the riearest point of the building such parking area is required to serve. Off-street parking areas must be accessib-le by a public street or alley and I shall be owned or leased by the owner or 1easee of the building or use being served by such parking. Such parking lot shall be maintained as a parking lot so long as the building and/or use served is in operation or until another suitable parking area is established for such building or use. Required parking spaces shall be located so as to preclude parking maneuvers onto any public right~of-way from any use, with the exception of single and multi::-fami1y dwellings, as defined in this ordinance. Required parking spaces shall not be located in any required fronltor side yard, except for detached single-family dwellings, townhouses and mobile homes as specified in Section 18.84.050. Section L That Section 18.84.050 of the Bozeman Municipal Code be, and the same is hereby amended to read as follows: 18.84.050 Minimum Off-street Parking Requirements The following table indicates the number of off-street parking spaces required in a1 I districts for those particular uses listed. USE PARKING SPACE REQUIRED LOADING SPACE REQUIRED Detached, single-family Two spaces per unit, one space of dwellings, townhouses and which may be within a driveway area mobil e homes in the required front yard area except as noted in Section 18.76.060 I for townhouses. Two and one-quarter (L~) spaces per unit. Section 3 This Ordinance shal-I be in full force and effect from and after thirty (30) days after its adoption. PASSED.
